Also, b) is very difficult to prove.

They don't have to prove it Juan.
They just have to arrest a few people (I presume that still involves handcuffs, intimidation, public humiliation, spending a night or two in jail, loss of employment, etc).
So it goes to court and are found not guilty.
So what?
Your life has still been tremendously upset at best, ruined completely at worst.

I don't even live in the same country as this law, and it bothers the hell out of me.
