Some things wherein folks are "damaged" should remain outside the purview of
the government and reside only in the realm of tort law wherein the
government's only role is as a referee between a plaintiff and a respondent
for the sake of orderly resolution of grievances - just as with the laws
concerning slander. The less government is involved in the lives of people,
the more liberty abounds, the stronger individuals and the nation become. As
liberty is lost the more despotic the nation becomes and despotism
eventually leads to weakness and loss of everything. - my personal
observation of history.
Remember - government is raw power. Be careful what you feed it lest it
cease to be your servant and become your master.

My point here would be the motive of the person overhearing, recording,
photographing. That motive is not for anyone to decide but a court of
law. True, if it gets to court then it's usually too late, and harm has
already been done in some form or other. That's a sad fact of life. But
the balance between privacy and freedom is a fine one, and on average
seems to work (here in the UK). There will always be blips swinging one
way or the other, and these anomalies become highlighted by the press.
But its miles better than walking around clubbing each other with sticks.
