As a practical matter, what you do when you are charged a late fee is to call and cancel the card.

When they ask you why, you say a) because the late fee is obscenely high or b) because you misled me about how a late fee might be incurred.

They will then say, Oh, OK. We'll waive the fee just this time, but be good.

Obviously, this won't work if you do it every month. But every time I have been charged a late fee, about once every two years, I call up and cancel and get it waived.
