I think you are wrong here. International law has a material reality since it is embodied in formal treaties. And treaties are given the forcee of national law in most states. (I forget wht the Constitution specically states, but I do believe trefaties override domestic legislation in the U.S. This is seldom enforced in crucial matters, but it does make a potential diffference.
