I think he's right. If you fail to preserve ownership, then either the owner isn't you, or you're not root. If you're another person, then you can only do this if the owner of the directory has explicitly opened up permissions to allow this, and I think in that case it's acceptable that the ownership change silently. You see this in shared directories all the time; it's not a huge surprise.
