Even if it is legally taken and you have not stipulated it clearly at the start, then it could be covered by (assumed) personal privacy. But the computers in the office are company property which includes what is on them. The NBI and BSA are not going to let you get away with having illegal copies of computer games when they raid for MS software. It is the Administrator and the company to make sure that the computers are managed correctly. The employees don't have USB port access so i have to watch the emails, more carefully. I gather you don't have these types rules. We have a employee manual and it is referred to in the manual and the employment agreement has this specified specifically to do with phone calls, Emails, files on company computers, papers on desks or in drawers. Anything taken into the office created or used for business will be checked, read, reviewed, searched. We work in a company that works on banking details for clients, and we pursue a high level of integrity, and don't trust anyone. We even had a guard steal from the company. Blocking the Internet is easy, we have 5-6 employees with Internet access, and some of them are at a reduced level. Many employees have email but only 5 employees can send emails outside the company, but all can receive from the Internet. Also we have the standing order any abuse of any privileges with be dealt with complete access removal, and may include the punishment as defined int the employees manual. I have never spoken to anyone about their or another employees problems at home or other items that i have read, I don't need too discuss that type of stuff, I'm busy enough already. And some of it is in Tagalog and i'm not interested in the finner details i am looking for fraud, and abuses of policies defined previously. Some times I take a copy of a set of emails and request for it to be translated, as the conversation seemed to be IFY. This translation is done by a third party with names and certain items removed before it is given over. If i read something that we have no rules on, we could make a rule but it would not be able to deal with that item directly and can only cover items that occur a period after the rule is posted and explained to all employees. Also I do not personally fine or punish except with removal of Internet access. It must go through a 3 Person Investigation before punishments are decided and met out. Forwarding of emails the chain mails is banned but I dont jump up and down on all infractions, Mainly I am out to stop the distribution of Pornography and the photos of dead bodies, as forwarding some of these emails can be seen to be sexual harassment within the work place.
