I saw a talk at Freedom To Connect in Washington last month by a Chris Savage (attorney, Davis Wright Tremaine) called "Intelligent Regulation and the Death of the Chicago School": http://www.slideshare.net/f2c/chris-savage-1246598 which is somewhat relevant. I happen to think that the public (the users of the network) needs to seize control of the last mile infrastructure (either by purchase or by building its own).
