Rate limiting usually works on quota: as long as you're below the threshold, you're good. If you happen to be the unlucky guy, you're too late, and somebody else already has eaten your piece of the cake.
Therefore yes, this can come and go. With high activity times it's likelier, in the middle of the night less so.
