AFAIK, hwclock cannot not know by reading the clock device. It tries to
read /etc/adjtime to see if there is info about the hardware TZ. If
there is no info, it picks UTC. Have a look at man hwclock for the
authoritative information.
This is what my machine says at 7:51 PM local time. The hw clock is
indeed set to UTC:

You only need setting the hw clock to local time when using Windows (up
to XP, at least): it forces the clock to local time if it isn't.
Confusion ensues if you are dual-booting windows/linux.
