Which it turned out it hadn't. It was a hanging thread and actually that thread kept the App from being suspended. THAT is indeed kind of an OS issue since it did not happen pre-iOS4.1. Gapless: Working on it. Compatibility with SqueezeCast: THAT should be sorted in the current release.
