Not because they don't think they can win, but they can't easily collect as much in damages if the image wasn't registered. I may be mistaken but I seem to recall that specifically you can't recover court costs if the image wasn't registered. In other words its going to be harder for the lawyer to go through a very expensive trial process and still recover enough to even cover his fees. If I was a lawyer I wouldn't be falling all over myself to take on that type of work either. The culprit here is how insanely expensive it is to litigate even a very simple cut and dry copyright violation. Without registration its even more complex to prove your case and the potential settlement is less.
