Unfortunately this appears to be common practice with Conde Nast, however they should (and usually do) make their position clear before commissioning. Usually they send an agreement to be signed before the commission takes place,asking the photographer to give up all rights etc etc.

If your friend is in the UK it is well worth joining the EPUK forum where this type of issue is often discussed with sound advice given.

The invoice has been unpaid for five months already, before the contract was mentioned.
If they are not too bothered about working for CN again for a while they are perfectly in their right to sue for the money, small claims or on line. Without having signed anything before hand, CN don't have a case will have to cough or have a cc judgment against them.
