AFAIK regarding API there is almost similar precedence which do not
favor "using API makes it GPL" position:

That page is about something completely different. Also note that the MySQL library is not a pure GPL but has a special exception clause redefines derived works, so that does not apply here either.

SCO also claimed Linux breaches copyright because it had similar C
header files... didn't work out. It was standard API.

Please get your facts correct. That did not work out because that API was not owned by SCO.
