The fee that comes out of the settlement is for the class members' representation, the plaintiff. The defendent (Dell) has to pay its lawyers in addition to the settlement.
They could add the legal expenses to the damages but that would be bad for the defendant. Eventually it would mean more tax cuts for big business.
