The thing to say about all of this is that we are still praying for a miracle. I heard back today from the insurance company about our court bond for the stop notice. They are requesting nearly $60K in cash collateral. We thought they'd put a lien on the house for collateral, but instead they are demanding cash.
We don't have the $60K in cash, so there must be a Plan B out there that we haven't been able to use yet. A while back another contractor suggested that we send the contractor our own invoice for the overpayments we made to him, and which we do not owe because of the offsets due to us for rework, damage to materials, and walking off the job early. I did that and then filed a small claims case to attempt to enforce our invoice in court and collect those fees back. It is a $7500 case. We would be entitled to far more if we could go to civil court, but without the stop notice bond we'll have trouble waiting for that. I had really hoped we'd be able to get that bond, but we haven't found an insurance company willing to write the bond with our house as collateral. So now we are waiting for our 8/22 small claims court date to come up. Our attorney has also filed against his contractor's bond. We'll have to see what comes of these actions. A civil case could take up to 3 years to come to trial. If we can avoid the 3 year wait and go to small claims court it is worth giving up anything we might potentially recover in civil court. A bird in the hand, you know. Now Steve is back on track praying for that miracle. And I'm still looking for new clients. I signed one earlier this week and am hoping for lots more. Keep happy! If we can finish the house soon we'll be having classes soon too. This is such a perfect location for classes. 20 acres of oak woodlands, a stream, and pacific ocean breezes... Foxfire! User training is among the first offerings we want to make. We've had this property since the fall of 2000 after Steve's bout with flesh eating bacteria. He has survived 10 bouts of pneumonia and a heart attack out here. I really can't believe it is going to be over now. I will fight and fight and fight to make it happen. We are SO close.
