Sorry, I was under the impression that he was still able to add value to the
company. If not, while it would be nice, there is no reason to pay him. For
me, I'd take the project based pay.
Good luck! OTH, you have him sneak across the border from Mexico and set up a
US subsidiary. You might even get financial aid from our government if you do
that. ;-)
