John,

> Sounds like you are on an "up" cycle! Great news.

We're not out of the woods yet, but it is a big relief nonetheless.

Tuesday morning my second request for the TRO was in fact denied, but the
interesting part is that my argument seemed to actually be making some
headway. I've been getting hit with the text of the California Code that
Countrywide has been citing all along saying that they "may" withhold money
for an unbonded stop notice. This time I argued that regardless of the
statute, the contract is actually more strict and the terms in the contract
take precedence over the statute. The expression on the judge's face, along
with the silence from Countrywide's lawyer told me that I finally found the
right argument.

This bit of learning yesterday had me feeling a bit relieved already when I
was on my way to the federal court to file for bankruptcy. While I was
driving back to the bankruptcy court with papers I didn't have the first
time I went there in the morning, the lawyer called and told me about
canceling the sale that was set for today. I did not have to file bankruptcy
after all -- at least not today, but hopefully not at all.

What a huge blessing! It is a gift, and Steve and I have been enjoying the
lessening in our stress levels.

Right now, I'm sitting here next to him with a laptop as he rests in the
hospital bed. We're just keeping each other company while he heals up. So
far, very little bleeding is happening. Also, I put him on iron tablets for
the last 6 weeks so that he could better handle the blood loss from surgery.
The doctor was really impressed with his blood counts.

We're weathering well. Next I have to get some appraisals on my web sites
and see what I can sell to raise some funds for the mortgage bank. During
this time since I got laid off from EDS when they outsourced my job, and
then got my contract canceled three separate times by another client, I've
been building these web sites. All of them earn at least some money. And the
numbers get better and better as time passes.

I'm HAPPY today!
