Other provision of the constitution address the right to 
privacy and due process.

State, city, or community law cannot violate the rights 
granted in the Federal Constitution and its Bill of Rights, 
which is the highest law of the land.  However, state, city 
and local community laws vary greatly and are are not always 
applied evenly across all jurisdictions, but it would seem 
to me that a police officer would have his greatest 
authority when on location where a crime is possibly, or 
actually, in progress, whether it is in a home or otherwise.

Not ever law or enforcement procedure enacted by the states, 
cities or local communities adhere to the Federal 
Constitution, but it is expensive to take a case to the 
supreme court, and only the lucky have their case selected 
to be heard. so the standard in most jurisdictions is what 
is allowed within the community that elects its state, city, 
and local officials, and who serve a juries in various local 
courthouses across the state.
