That is correct. But you fail to mention that whomever is appointed has to
be approved by the Senate and they are now split 50-50. President Elect
Bush can appoint but the Senate can say NO. It has happened in my lifetime.

Nice thing about that is - Vice-president Cheney will be the tiebreaker after
