If I understand correctly what you said, I already get that - often - with
Netscape. But in Netscape case, that window can be closed and the last closed
window position is saved...
In that Netscape case, I used AppleScript to place the window location in the
screen area (fortunately, Netscape can be scripted).
In your case, I would checked the left and top position of the window and reset
it if the saved values are lower than... say... 0,44 (for example), values are
x,y and expressed in pixels.

I just had a user email me that the main window of an RB app (OSX and he
sent me a screen shot) went under the menu bar and he couldn=B9t get it back
out. On close, I save the window position. He says he dragged the window
up to get at something lower on the screen. I cant get it to do this. Its
a normal doc window type 0. The only way I could get it out of there was to
have him edit the prefs file.
Anyone know how this could happen?
