And the comment on EULA's is more an industry wide thing.
Someone, somewhere, needs to take this to court before it's really know what is / is not enforceable in one. It's often contended that there is much about them that is not enforceable but until it's tested it's hard to be sure.
And it will vary from jurisdiction to jurisdiction
