I've also realised this means that things like using GStreamer to
generate ReplayGain or MusicBrainz info would have to be done
out-of-process. And so it would make writing plugins that do anything
"interesting" with GStreamer more complex.

I think that would probably require embedded an actual lawyer in
GStreamer, as figuring it programmatically out may not be easy in many
cases. Like in this case, where it's perfectly legal to /use/ Rhythmbox
with the Fluendo MP3 decoder, just not distributing them together.
