I have hundreds of mixes ripped as FLAC and they're all gapless. MP3 can be gapless as well, provided it's encoded properly (i.e. with a reasonably modern version of lame). Whether an mp3 created via a splitter will be gapless I can't be sure, but I would think so as it will most likely do the split on a frame boundary.
