Dear Sir, 

Kindly refer to letter F. No. CIC/MA/A/2008/00088 dated 28th January
2008 from Mr. L C Singhi, Addl Registrar.CIC, New Delhi informing me
of the scheduled hearing of second appeal on 4th April 2008. I quote
the following from the said communication addressed to the
undersigned. My copy of the letter has no cc to anyone.

Quote:

The CPIO should submit comments to the Commission endorsing a copy at
the earliest. The CPIO may also appear for hearing.

Unquote
In this regard, the following information is requested under the Right
to Information Act 2005.

1.      Reasons for not giving specific time limit to the concerned CPIO to
submit his comments to CIC and to the RTI appellant.

2.      Reasons for not seeking similar comments from the concerned
defaulting FAA.

3.      Reasons for firming up the date and time of hearing without getting
comments from the CPIO & FAA and also before the rejoinder of the RTI
appellant based on the comments of the CPIO and FAA.

4.      Reasons for making the presence of the CPIO during the hearing
optional.

5.      Reasons for maintaining silence on the presence of the defaulting
FAA during the hearing.

6.      Reasons for not giving specific direction to the defaulting CPIO
and FAA to remain present during the hearing. If given, reasons for
not keeping the RTI appellant informed about it.

7.      Concrete action taken, if any, by CIC to ensure the presence of the
concerned defaulting CPIO and FAA during the hearing.

8.      Reasons for fixing the date of hearing by keeping the
above-mentioned administrative loose ends.

9.      No. of cases heard by CIC till 31st January 2008 without giving
specific direction to the concerned CPIOs and FAAs to remain present
during the hearings.

10.     No. of cases heard by CIC till 31st January 2008 without ensuring
the presence of the concerned CPIOs and the FAAs during the hearings.

11.     No. of cases heard by CIC till 31st January 2008 with some other
officer (s) representing the CPIOs and the FAAs during the hearings.

12.     No. of such hearings, violating all the above-mentioned requisites
and in violation of principle of natural justice, carried out by CIC
till 31st January 2008.

13.     No. of such hearings, by keeping the administrative loose ends,
planned by CIC till 4th April 2008.
