Dear All,
What shall a person do, if a department, say Income Tax Department on your RTI
application demands Rs. 40 (@ Rs.2/- per page of information) + Rs. 60/- for
postal charges and then provides you information on a single sheet?
Here is the chronology:
1. 02-08-2008: Tax Evasion Petition alongwith RTI for status of investigation
filed along with the Delhi HC order that such information must be disclosed as
TEP is an outcome of public action and hence the information on current status
should not be denied.
2. 03-09-2008: Reply given from the CPIO asking for Rs. 100/- as RTI fee (Rs.
60/- for postal charges + Rs. 40/- for twenty pages worth information)
(Recieved on 08-09-2008)
3. 09-09-2008: Payment remitted by DD payable to the concerned authority.
4. 30-10-2008: Reply provided on one page that investigations are still on and
the information can not be disclosed. (Recieved on 07-11-2008)
My Queries are:
1. Is it denial of information (In the wake of Delhi HC decision it seems so)
2. What happens to the payment of Rs. 40/-
3. Is there a delay of information as the information for RTI dated 02-08-2008
was given on 30-10-2008, though there has been a intermediate information
requesting more money for additional pages.
I seek experienced members to guide me in this matter.
