Mr Subodh Dakwale,Mr Mahendra Sharma, Mr T Chatterjee, Reportedly Dismissed IOC Officers.
Dear Sirs, The latest Supreme Court judgment of 26.03.09 on Reasoned order is to be given for dismissal of appeal of dismissed employee may be useful to you in defending yourselves. It is posted at - http://www.esnips.com/doc/da92a59d-a7fd-4429-8097-a5c08326a08c/Supreme-Court-Reasoned-order-is-to-be-given-in-case-of-dismissal-of-appeal-of-dismissed-employee-260309 The judgment is available at the Supreme Court of India website - http://supremecourtofindia.nic.in/ Other High Court judgments can also be downloaded from the website based on the information about petitioners / respondents / name of judge / date of judgment / phrase used in the judgment etc. The website is highly user friendly and the judgments are also uploaded on day to day basis. Large no. of higher court judgments support the crucial principle that "Unreasoned order is arbitrary and hence illegal" . It means the concerned authority is required to give reasons for taking any decision (or for that matter not taking decision) - administrative or quasi-judicial. While Mr Satish Kumar ED (HR) IOC New Delhi, in his capacity as CPIO under the Right to Information Act 2005, informed me that performance appraisal for IOC officers was required to be kept confidential, he did not inform me the reasons for doing so. His unreasoned order was incidentally vetted by Mr V C Agarwal Director (HR) IOC, as first appellate RTI authority, without giving any reason as to why he agreed with the decision of the CPIO. Based on my experience of using the Right to Information Act 2005, since inception from 12th October 2005, and on going through no. of higher court judgments / RTI appeals / RTI decisions, I find the judgments are easily understandable. And, they can be made use of in day to day working life for improving the governance.
