Large no. of higher court judgments support the crucial principle that "Unreasoned order is arbitrary and hence illegal" . It means the concerned authority is required to give reasons for taking any decision (or for that matter not taking decision) - administrative or quasi-judicial. While Mr Satish Kumar ED (HR) IOC New Delhi, in his capacity as CPIO under the Right to Information Act 2005, informed me that performance appraisal for IOC officers was required to be kept confidential, he did not inform me the reasons for doing so. His unreasoned order was incidentally vetted by Mr V C Agarwal Director (HR) IOC, as first appellate RTI authority, without giving any reason as to why he agreed with the decision of the CPIO. Based on my experience of using the Right to Information Act 2005, since inception from 12th October 2005, and on going through no. of higher court judgments / RTI appeals / RTI decisions, I find the judgments are easily understandable. And, they can be made use of in day to day working life for improving the governance.
