Really a good issue raised from the platform - 'Humjananege'. I am of the view that NGOS are taking benifit of 80G and 12-A, thus are in a way using public funds. Plus all the BGOs claim and proundly say that they work with community, for community and mainly through community. The most important that NGOs expect that government ot function in trasnparent manner, should be accountable. I think this laso applied to NGOs. I will not be able to represent to the commission. But support you in this hearing. We get such calls frequently from director of NGOS on our RTI helpline for seeking guidence on how to respond to RTI applications. Many a times they also try to seek guidence for denying information, to our surprise. (which off course is discouraged by RTI volunteers by giving proper guidence about RTI) These are the issues which we need to talk more, discuss and debate wherever and whenever possible. I remember one my fellow volunteer of RTI helpline always comment after attending calls of the NGOs regarding RTI......" Demanding for Transparency is not picnic.... its painful process.... NGOs should understand....." M.L. Sharma, Delhi. I request presence of those who may want to present their views before the Commission. Three hearings have been conducted into a matter involving disclosure of income tax returns and other documents that the NGOs submit with the income tax authorities to claim exemption u/s 80G. The public authority is seeking to deny information on the ground that it is personal information whereas I am arguing that all NGOs, especially ones seeking exemption, grants and subsidies, claim to work for the welfare of public which is clearly a matter of public interest. NGOs cannot claim protection from disclosure of information which is held by the Government.
