I beg to differ. A Public Authority may appoint any officer (it could be gazeted or non-gazetted or even a Class IV Officer - a Chaprasi) as PIO to represent that Public Authority who make such appointment. If any public authority appoint an officer who is not competent to act as PIO, the responsibility and accountability is purely on the Public Authority who make such appointment. With such appointment the PA is in fact delegatting such PIO to represent or act on behalf of thePA in performing the duties so dictated in the RTI Act. If any particular PA furnish any foolish reply to a cityzen in response to an RTI application, the responsibility ultimately falls on the PA either to support his PIO or take appropriate action against the PIO for furnishing a foolish reply. The cityzen has no concern as to who is the PIO. The reply he get it is deemed to be fromthe PA or an officer delegatted by him as the PIO interms of RTI Act.
