Jim, the 40-year rule didn't exist until 1974, and it is not an FRA regulation. It's included in the AAR Interchange Rules, which carries no penalties. A road can refuse to accept an over-40-year-old car in interchange, or it can choose to accept it. In fact there are some examples of two or more roads having old cars in a particular service that continue to run past 40, by mutual agreement to waive the rule.
