I must agree with Bert Cutler's sentiments, if not his conclusion. I've been
seeing posts generating more heat than light for the past week or more and am
weary of them.
Such free time as I have has been spent actually working on model railroading
(including a kit for Ed L.) instead of arguing about intellectual property
rights.
So far no one with real expertise on matters of copyright or trade marks (and
they are different) has weighed in, and there seems to be a lot of spinning of
wheels; and
even the experts are not agreed, since the field is murky and getting murkier
since the last meddling by our political hacks--this is why lawyers get rich.
I know enough about the law to understand the concept of standing--which means
that one has a stake in the outcome--and so far no one with standing has spent
any
time or energy on this.
Stan F. created a unique result, and Bill bought the result from his estate; in
the absence of clear title to the contrary, it becomes his, just as when one
buys a painting, etc.,
one owns reproduction rights--unless the creator has specifically reserved them
or assigned them, and so far there has been no solid information of that,
merely speculation
and theorizing. There is a great deal of those unproductive and addictive
trends on this list, and some of us have to wonder whether the primary model
railroad activity for
some members is sitting at their keyboards instead of their workbenches.

This thread has become a big ugly pile of suggestions, innuendo and questions
by third parties who have no actual "standing" with regards to rights or
ownership of anything related to the project. My "BS" meter was spiking a while
back, and a lot of other list members are simply not interested in any of this
back-and-forth without a shred of real information. If Ed or anyone else wants
to assert they own something, they should have contacted Bill directly.
