Reservation of 3 per cent for differently-abled persons should have to be computed on the basis of total vacancies in the strength of a cadre and not just on the basis of the vacancies available in the identified posts...not less than 3 per cent of the vacancies for the persons or class of persons with disability, of which 1 per cent each shall be reserved for persons suffering from blindness or low vision, hearing impairment and locomotor disability or cerebral paly, the court said. It also threw out the government's argument that an overall 3 per cent reservation in the cadre strength in Group A and B could violate the rule of 50 per cent ceiling of reservation for SC, ST and OBC candidates, as laid down in the Mandal judgement. The court held there was no applicability of Mandal judgement in this case while criticising the government for its specific opposition to reservation for the disabled, particularly in Group A and B posts. The court lamented that although the the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act was enacted way back in 1995, the disabled had failed to benefit from it Employment is a key factor in the empowerment and inclusion of people with disabilities. It is an alarming reality that the disabled people are out of job not because their disability comes in the way of their functioning rather it is social and practical barriers that prevent them from joining the workforce. As a result, many disabled people live in poverty and in deplorable conditions. They are denied the right to make a useful contribution to their own lives and to the lives of their families and communiy, the court said. Welcoming the decision of SC Bhushan Punani Executive Director of the Blind People's Association (BPA) Ahmedabad said Supreme Court has passed a very bold judgment directing all the State Governments and the Central Government to implement reservation of 3 % jobs for persons with disabilities and to complete the backlog within 3 months. Unfortunately, Gujarat paints a sad picture here. Punani also adds to say, The Government of Gujarat has taken the liberty of issuing a notification contrary to the provisions of reservation and has wrongfully denied appointment of blind persons as Vidya Sahayaks which in contradiction to the provisions of law A bench headed by Chief Justice P Sathasivam also clarified that the principle of not exceeding more than 50 per cent reservation would not be applicable while granting quota for disabled persons. The apex court directed the authorities to compile the number of vacancies in all their departments to give jobs to disabled persons under three per cent reserved quota within three months. The bench said it is an alarming reality that disabled persons are not getting jobs because of various social barriers forcing them to live life in poverty and negligence. It said the Government has categorical obligation to protect the right of disabled persons and passed a slew of directions for providing jobs to the differently-abled under the Persons with Disabilities Act. While this bold judgment of the Supreme Court which in reality validates provisions of Section 32 of the Persons with Disabilities Act is a very welcome step and needs to be appreciated. As per Section 33 of the Act, the Central and State Governments are expected to extend reservation to persons from respective categories of disabilities in the jobs selected and notified by the respective Government. While the Ministry of Social Justice and Empowerment has revised the list of identified post till the year 2013, the Government of Gujarat has issued or adopted any list of identified posts so far. As per the precedent, State Government is expected to follow the List of Identified Posts as issued by the Central Government in the absence of such list issued by the respective State Government. Welcoming the decision of SC Bhushan Punani Executive Director of the Blind People's Association (BPA) Ahmedabad said Supreme Court has passed a very bold judgment directing all the State Governments and the Central Government to implement reservation of 3 % jobs for persons with disabilities and to complete the backlog within 3 months. Unfortunately, Gujarat paints a sad picture here. Punani also adds to say, The Government of Gujarat has taken the liberty of issuing a notification contrary to the provisions of reservation and has wrongfully denied appointment of blind persons as Vidya Sahayaks which in contradiction to the provisions of law A bench headed by Chief Justice P Sathasivam also clarified that the principle of not exceeding more than 50 per cent reservation would not be applicable while granting quota for disabled persons. The apex court directed the authorities to compile the number of vacancies in all their departments to give jobs to disabled persons under three per cent reserved quota within three months. The bench said it is an alarming reality that disabled persons are not getting jobs because of various social barriers forcing them to live life in poverty and negligence. It said the Government has categorical obligation to protect the right of disabled persons and passed a slew of directions for providing jobs to the differently-abled under the Persons with Disabilities Act. While this bold judgment of the Supreme Court which in reality validates provisions of Section 32 of the Persons with Disabilities Act is a very welcome step and needs to be appreciated. As per Section 33 of the Act, the Central and State Governments are expected to extend reservation to persons from respective categories of disabilities in the jobs selected and notified by the respective Government. While the Ministry of Social Justice and Empowerment has revised the list of identified post till the year 2013, the Government of Gujarat has issued or adopted any list of identified posts so far. As per the precedent, State Government is expected to follow the List of Identified Posts as issued by the Central Government in the absence of such list issued by the respective State Government. If you want to try playing audio game, consider playing shades of dune, g m a tank commander, sarah and the castle the whitch craft and wizardry, top speed 3, eric the cleric. All of such games are audio game, and all are my favorite. In order to play the sara and the castle... you have to have the thorow knowledge of harripotter. Shades of dune and gma tank commander require more logic to play, top speed 3 need no any such chalanging, don't need to think much before playing but it is most enjoyable, and eric the cleric is also the most difficult game as it require more thinking. But once you understand the game, it is more romantic. No casual vacancies Amba solelkar Indian express Supreme Court creatively interprets a statute to expand quotas for the disabled. There is less than meets the eye when it comes to the recent Supreme Court decision, said to guarantee a 3 per cent reservation in government jobs for persons with disabilities. Even a crusading full bench could only do so much against a loophole riddled statute. The Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995, introduced the concept of a minimum 3 per cent reservation in all establishments - that is, corporations established by law; authorities and bodies owned, controlled or aided by the government; government companies and all government departments - for certain categories of persons with disabilities. Section 32 of the act mandates the government to identify posts in establishments under it, which can be reserved for persons with disabilities. The confusion was created by section 33, which said that a minimum of 3 per cent of all vacancies in an establishment would be reserved for persons with disabilities, of which 1 per cent each would be reserved for three categories of disability: first, blindness or low vision, second, hearing impairment and third, locomotor disability or cerebral palsy. These reservations would be in the posts identified for each disability. The Union of India had argued that the 3 per cent figure was to be calculated on vacancies within the posts identified for reservation by the government under section 32. This severely limited the number of posts that would eventually be reserved for persons with the specified disabilities. The court had two issues to resolve: how the 3 per cent reservation was to be calculated, and whether this calculation was to be based on the total cadre strength or only the vacancies available in the cadre. The government's interpretation was leading to a clearly absurd result, quite contrary to the aims of the statute concerned. The court proactively and creatively interpreted statutory provisions to avoid this. It held that in light of India's constitutional obligation to be a welfare state, and based on an interpretation of the intent and purposes of the parent statute, the 3 per cent reservation in section 33 could not be limited only to the posts identified for reservation under section 32. To determine legislative intent, the court also relied on the provisions of the draft Rights of Persons with Disabilities Bill, 2012. In the draft bill, the court found that the intent to extend the reservation beyond identified posts was very clear. Relying on a draft legislation to determine the legislative intent of a provision drafted in 1995 is quite unprecedented. But the court seems to have been eager to do justice to persons with disabilities and the wording of the statute left it in no doubt that the reservations were meant to be vacancy-based and not post-based. The vacancy-based reservation approach poses a problem, because in order to reach a stage where 3 per cent of vacancies are even available for reservation, a substantial number of vacancies must arise in the cadre of each establishment. It seems difficult to even estimate how long it would take for the first set of reservations, post this ruling, to actually come into effect. Be that as it may, and despite working in the disability sector, I cannot find fault with the plain interpretation of the statute by the court. Let it not be said, however, that concern regarding vacancy-based reservations was never raised outside these legal proceedings. In 2010, the ministry of social justice and empowerment constituted a committee, comprising persons with disabilities as well as representatives of organisations working with such persons, under Sudha Kaul. It was meant to draft the bill mentioned above. In the legal consultations held, it was observed that the reservation of vacancies instead of posts needs to be re-examined. The committee draft of 2011 reflected this, with the proposal that, All establishments shall reserve not less than 7 percent of all posts. for persons with disabilities. If this clause had been part of the draft bill finally considered by the court, things might have been different. Unfortunately, the proposed section 39 of the bill states, Every appropriate government shall reserve not less than 5 per cent of the vacancies meant to be filled by direct recruitment. We can argue endlessly about what the court should and could have done to promote inclusion, but it is of the utmost necessity to seek appropriate changes to the draft bill, which, despite the apprehensions of the disability sector, is in the final stages prior to introduction in Parliament. In doing so, the court made a larger point that must focus policymaking on other aspects of the social, educational, training and healthcare landscape to give the disabled their right to full participation. Pointing to technological advancement that allows people to vault over their disabilities, it said, the actual limitation surfaces only when they are not provided with equal opportunities. It is important that this country take full stock of the limitations currently being imposed on millions of people from gaining their right to equal opportunity. At the very obvious, and basic, level, consider the impediments to mobility, from transportation to building access, let alone the lack of supplemental signage for the visually or hearing impaired. In fact, even the landmark legislation on the right to education did not originally factor in issues of access for the disabled, and it took considerable mobilisation to force an amendment. The fact of guaranteed jobs does not just change the statistics radically. It also forces the reconfiguration of workplaces - in terms of job profiles, physical infrastructure and HR support - to make an inclusive environment the new normal. Every consequent investment in ancillary services - transportation, training, disability-specific aids - and every change in social attitudes can be a force multiplier. In a society like ours, still struggling to obliterate the gaps in opportunity on account of widespread economic deprivation, this effort to factor in the rights of the disabled in every development and welfare effort is particularly challenging, and crucial. However, policymaking is still hampered by the struggle to even identify the disabled. The 2001 census listed just 2.13 per cent of the population as disabled. Experience worldwide has shown how the question is posed is crucial. Asking someone bluntly if she or her ward is disabled is less likely to yield a positive reply than if she is asked if they have difficulty in carrying out a daily task, be it reading, walking, communicating. It's time target beneficiaries are enabled to identify themselves as rightful claimsants for support, and sensitively so. In a game-changing invention, engineers at Disney Research, Pittsburgh, have developed a new technique that allows you to feel the texture of objects seen on a flat touchscreen. The novel algorithm enables a person sliding a finger across a topographic map displayed on a touchscreen to feel the bumps and curves of hills and valleys, despite the screen's smooth surface. The technique is based on the fact that when a person slides a finger over a real physical bump, he perceives the bump largely because lateral friction forces stretch and compress skin on the sliding finger. By altering the friction encountered as a person's fingertip glides across a surface, the Disney algorithm can create a perception of a 3D bump on a touch surface. The method can be used to simulate the feel of a wide variety of objects and textures. Our brain perceives the 3D bump on a surface mostly from information that it receives via skin stretching, said Ivan Poupyrev, who directs Disney Research, Pittsburgh's Interaction Group. Therefore, if we can artificially stretch skin on a finger as it slides on the touchscreen, the brain will be fooled into thinking an actual physical bump is on a touchscreen even though the touch surface is completely smooth, Poupyrev said in a statement. In experiments, researchers used electrovibration to modulate the friction between the sliding finger and the touch surface with electrostatic forces. Researchers created and validated a psychophysical model that closely simulates friction forces perceived by the human finger when it slides over a real bump. The model was then incorporated into an algorithm that dynamically modulates the frictional forces on a sliding finger so that they match the tactile properties of the visual content displayed on the touchscreen along the finger's path. A broad variety of visual artifacts thus can be dynamically enhanced with tactile feedback that adjusts as the visual display. The traditional approach to tactile feedback is to have a library of canned effects that are played back whenever a particular interaction occurs, said Ali Israr, a Disney Research, Pittsburgh research engineer who was the lead on the project. This makes it difficult to create a tactile feedback for dynamic visual content, where the sizes and orientation of features constantly change. With our algorithm we do not have one or two effects, but a set of controls that make it possible to tune tactile effects to a specific visual artifact on the fly, Israr said. While this bold judgment of the Supreme Court which in reality validates provisions of Section 32 of the Persons with Disabilities Act is a very welcome step and needs to be appreciated. As per Section 33 of the Act, the Central and State Governments are expected to extend reservation to persons from respective categories of disabilities in the jobs selected and notified by the respective Government. hi, just go to add or remove programs from your control pannal, and then navigate with your arrow keys till u reach photon plus, or whatever other program u want to remove. then press tab till u here change/ remove. once u hit enter there, it will uninstall the program, and your done with it for life.
