You are invited to the Northeast Product Safety Societys 20th annual
membership dinner meeting on Wednesday, May 28th, at the Holiday Inn,
Marlborough MA featuring Edward T. Butt Jr., Attorney with Swanson
Martin  Bell, LLP, will discuss what you can do to better defend  and
prevent  product liability suits.  Attorney Butts discussion will
focus on what you can do now so that you can defend future products
liability cases more successfully  and better yet prevent them in the
first place.

If you will be in the area on May 28th, please consider joining us for

with product safety.  If you are not yet an NPSS member, this is a great

A Filet Mignon entrée dinner with salad, assorted vegetables and potato
will be served.  Dessert will include assorted apple crisp, pies,
coffee, and tea.  Coffee service will be available at 5:00 PM and the

Attorney Edward Butt has spent over thirty-five years defending
technically complex lawsuits.  For the past twenty years his practice
has become increasingly focused to the point where now almost all of his
work is defending several manufacturers of industrial machinery on a
nationwide basis in products liability cases and consulting with them on
product safety and products liability prevention.

Ed is admitted to practice law in Illinois, Wisconsin and Michigan, but
he has handled cases in at least twenty-nine states throughout the
country.  Ed is of counsel to the law firm of Swanson, Martin  Bell,
LLP, based in Chicago.   He is a 1971 graduate of the University of
Michigan Law School and a 1968 graduate of Lawrence University.  In
college he majored in economics, but he also took a heavy concentration
of math, chemistry and physics courses.

The CSA publishes design guides for its clients that are somewhat
useable by developers.

FWIW, UL60950-1 specifies, in addition to the stated
requirements, IEC61558-x for some general xfmr tests, and UL 1585
(to be obsoleted by UL 5085-x) for Class 2/3 power sources.

The comment by Mr Woodgate is good advice - as my employer's
designers seem to have many problems with using the 'raw' safety
standard as a design guide. So for each project, I write some
summary tables of construction requirements, performance/test
requirements, and spacings that would apply to the particular
project.

For component transformers, I point all new product designs to
use only IEC61558-x and/or UL5085-x, which can get them into most
IT and consumer products.

There was a previous PSTC thread that discussed the use of
software as a safety-critical component.

The Therac-25 is an oft-cited example in school ethics papers.
This incident is poorly understood by people that have not
performed formal software verification and validation.

From a purely software engineering point of view, in the
philosophic meaning, there was no breach of ethics by the design
team, and there was no failure of the Therac software. While poor
test design failed to reveal the problem, the root-cause was an
incorrect design specification. 

It my opinion, it seems that the manufacturer's management had a
morals problem.

manufacturer's point of view and hypothetically what they should
or could have done differently to solve the issue if I was their
consultant.

Primarily I am interested in the ISO/IEC or international safety
standards for software programming of industrial equipment or
medical devices. Not necessarily to reference them but to
understand the scope and to realize what the manufacturer
needed/needs to do. This would also hypothetically be presented
to the business management team that contracted me.

I am a little curious too as to what extent this event has taken
the existing industry. I have read that the standards have added
unnecessary time to an already laborious process. 

I look forward, as always, to your comments.

If I remember correctly, the units that did not use a standard

a simple registration  a request for a donation once you have logged-in. 
It's very useful and enables on to design ANSI or OSHA safety signs in

Someone recently brought up a point that I am wrestling with though. What
EXACTLY are the manufacturer's root ethical issue(s) here? I have the
following so far:
 
0.) doing a software safety analysis AFTER the machine has been commercially
available - what kind of motivation would the manufacturer have to pass!!
1.) Releasing software that that had an insufficient safety analysis - was fau
lt tree bad or was that accepted practice in 1983?
   if 1.) is not the root, then:
2.) Inadequate response to 6 injuries/overdoses in 9 months. this was a
million dollar machine but hey, what is the value of a human life?
3.) Knowingly leaving an unsafe product on the market for 10 months until
units were required to be shutdown by the FDA   CRPB. same comment as above.

Obviously IEC, ISO and the other standards agencies are encouraging you all to
do the right thing.

It brings up a situation I ran into where our town was building a children's
playground. The playground safety standard price was larger than the budget
for the playground. The standard was ignored.

lectrical/pneumatic/hydraulic/mechanical)

ISO 13849-1 and -2

 

(There are many other standards based on/derived from IEC 61508.)
