As the BCI vice chairman, Mr Adish Aggarwala put it: It's not a case or two here and there. It's almost rampant. India's 21 High Courts have about 500 judges in position, the rest of the sanctioned 647 posts being vacant. Reports from Bar groups and members show that more than 100 judges in 16 High Courts have relatives some as many as four or five enrolled or practising in the same court. They include judges' sons, daughters, parents, siblings, nephews, nieces, uncles, cousins, in-laws and so on. Bar groups in Gujarat, Uttar Pradesh, West Bengal, Orissa and parts of Madhya Pradesh have yet to reply, Mr Aggarwala said. The practice is a definite 'don't' under the BCI rules of standards of professional conduct and etiquette. The BCI rule: An advocate shall not enter appearance, act, plead or practise in any way before a court, tribunal or authority mentioned in Section 30 of the Act, if the sole or any member thereof is related to the advocate as father, grandfather, son, grand-son, uncle, brother, nephew, first cousin, husband, wife, mother, daughter, sister, aunt, niece, father-in-law, mother-in-law, son-in-law, brother-in-law, daughter-in-law, sister-in-law. The ball was set rolling a few months ago with the BCI asking Bar associations and state Bar councils to send particulars on members practising in High Courts presided over by relatives. A few weeks ago, Bar leaders held a news conference and disclosed names of 32 judges of Delhi, Mumbai and Rajasthan High Courts who between them have 44 relatives practising law in their courts.They explained that such bench-bar kinships were viewed as a possible source of corruption. The law fraternity is anguished and disturbed at corruption in the indian judiciary and allegations of unfair means adopted by some of the near relations of the judges practising in the same court, they said in a statement. They sought the Chief Justice of India, Mr Justice V N Khare's intervention to transfer all those judges whose relations are practising in the same courts to check such unfair practice. Alternatively, the Bar leaders said the state Bar councils have to initiate disciplinary proceedings against the relations of the judges who are practising in the same courts.They made it clear that lawyers in such a situation were forbidden to practise in the entire court not just before a specific bench. Asked what the BCI will do with the information, Mr Aggarwala said it was forwarded to the government which had received inquiries from MPs and was also being transmitted to Mr Justice Khare for action.The Bar spokesman recalled similar efforts made in 1993-94 during the tenure of former chief justice, Mr Justice M N Venkatachaliah. At a BCI workshop at Kollam, Kerala a year and a half ago, India's then chief justice, Mr Justice Sam Piroj Bharucha indicated that as many as twenty per cent of judges were corrupt. More than 80 per cent of the judges in this country, across the board, are honest and incorruptible, he said. It is that smaller percentage that brings the entire judiciary into disrepute. Her friend suggested that she should collatge such stories as they would provide a hostory of the rich Goan culture and traditions. Dr. Rodrigues is now drawing on the wewalth of experiences that exist within the Goan Community. She is calling for stories/anecdotes which can be about anything concerning Goa and Goans. These may take the form of a simple rec0ollection of a family or of a cultural event, thjey may be a humourous accoutn of an escapade or an occurence or simply something which you would like recounted for posterity. The stories can be in the first person, as this often makes them more interesting and easier to read. She hopes to edit the collection and to submit it for publication at some stage. Dr. Rodrigues has already received a good response. This committee is yet to finalise its report. The final decision will be taken after ascertaining the financial and economic viability of the project, said Rudy. Publication for expatriate Keralites on the anvil By Sanu George, Indo-Asian News Service Thiruvananthapuram, July 29 (IANS) Kerala legislators were informed Tuesday that the government is planning to bring out a journal that would focus on the needs and problems of the state's large expatriate community. Non-resident Keralites (NRK) Minister M.M. Hassan mentioned the publication plans while speaking in the assembly on various proposals before his department to help the 1.6 million Keralites settled abroad, mostly in the Gulf region. Among other things on the agenda of Roots-Norka -- a state-run agency that looks after the welfare of NRKs -- is the teaming up of various Malayali organisations both within India and abroad, he said. Also planned is an identity card for Keralites living in India. The government is even planning a legal cell to help Keralites within the country embroiled in cases. A major demand before Hassan's department is for reservation of seats in Kerala's higher education institutions for NRK children and setting up of examination centres abroad so they do not have to come to their home state to appear for entrance tests. Satish Nampoothiripad, the CEO of Roots-Norka, said the plan for the publication for NRKs is in the early stages, but we are committed to come out with the journal. Nampoothiripad told IANS: Right now we have a website for NRKs and on that we bring out a bimonthly newsletter. We are thinking of bringing out a hard copy of that and we plan to get articles from NRKs interested in writing. On the new insurance-cum-pension plan for NRKs brought out along with the Life Insurance Corporation of India (LIC), he said it is picking up but there are a few bottlenecks with regard to medical check-ups for the policyholder. Miguel: The design of road,specially the 'banking'on the turns,has to be part of the policy.The road to Mussourie is a pleasure to drive on.Hopefully,the BRDO will do a similar job of the Verna to Vasco road. Our PWD(Roads div.) engineers could get hands on training with the Army Unit now in Goa. Policies of the Town Country Planning Dept.,PDAs,Corporations,Zilla Panchayats and Panchayats on set-back,road access,etc affect the traffic flow as much as Parking,One-Way and other measures notified by the District Collectors from time to time. Policies must be based on data.Data must be collected---not manipulated. Therein lies the hitch as everyone wants a quick fix! The MARG has also urged upon the government to revert substantial part of the revenue collected as a road fine by the police to the police traffic cell to satisfy their genuine needs. Miguel: There is no need for this.All departments will want their revenues next.Education is free and hence there is no revenue. Who will fund such departments and from where? Ideally, the traffic police should be separated from the police force and made into a separate directorate in the same department( Just as the Directorate of Fisheries,Animal Husbandry and Agriculture can function as one Department,so can traffic,CID,ANC and regular police function as separate directorates in one Department) The technical staff ,e.g. the traffic cop or the CID investigator,should be non -transferable between the Directorates. It is not funny to see a CID inspector of yesterday issuing a challan for overspeeding today. It is a waste of trained manpower. It has also said that driver training institute which issues approval certificates to apprentices should be established in Goa. Miguel: This is specially important for heavy vehicle drivers who are illiterate and do not know the hazards(including to themselves) of the materials they carry. It is not funny that there is no two-wheeler driving school given the fact that there are more motorized two-wheelers(scooters/mopeds/mobikes) on the road in Goa than all the other vehicles (including cycles) put together !!! The craze of travelling to school on motorcycles ridden by underaged schoolboys and girls must be curbed by penalizing the person who has paid for the vehicle/given it to the minor rider. At a meeting convened by the Department in Panjim other issues discussed were, non-issuance of bills, provision of second cylinders, transfer of connections from other LPG dealers, mandatory mechanical checkup of the equipment in every household, emergency service in case of leaking LPG cylinders, conducting of safety workshop on the island and regular meetings with the Customer Service Officers for redressal of complaints. The meeting was chaired by Director Civil Supplies N.B. Narvekar and attended by Asst. Director Consumer Affairs Ashutosh Apte, member State Consumer Protection Council Roland Martins, Hindustan Petroleum Senior Sales Officer LPG Rakesh Maheshwari, and Bharat Petroleum Senior Sales Officer LPG Jitendra Jiandani. The distributors and retailers stated that to curb unemployment and promote self employment the government should offer soft loans with subsidy for purchase of fridge, rickshaw, etc. in order to promote youth to venturing into business of milk. Over 150 distributors and retailers from all over Goa gathered at the meeting and aired their grievances. Majority of those present were agents of Goa Dairy who complained that dumping of milk from outside the state was due to cut-throat-competition between the sellers in Goa. They alleged that low commission by Goa Dairy, stopping of petrol allowance and the recent MRP controversy were the major problems faced. Further, they alleged that there was a delay in paying commission by Goa Dairy to the agents. The members, who had gathered, formed an All Goa Milk Traders Association (AGMTA) of which Jayant Katkar was elected President. --- Documented by Goa Desc Documentation Service circulated by Goa Civic Consumer Action Network (GOA CAN)[EMAIL PROTECTED] Ph:2252660 --- - Third misappropriation case registered against Khalap, 13 others --- The Crime Branch of the state police has registered third misappropriation and cheating case against the former chairman of Mapusa Urban Co-operative Bank (Bank of Goa), Mr Ramakant Khalap and 13 others in connection with the release of Rs 3.5-crore loan to City Men's Estate Pvt Ltd, a partnership firm, without allegedly following proper procedure for its project Vasanta Farms. The complaint has been lodged with the police by the Managing Director of the bank, alleging that the loans were released by the earlier board of directors without verifying the documents and thereby led the bank into financial crunch. The case has been registered under section 420 and 408 of the IPC. The partners of Vasanta Farms Anna, Joseph, Shoba, Sajjan, Satish J, Karimotton of the City Men's Estate Pvt Ltd have been made alleged accused in the case. The police sources indicated that all these partners would be brought to Goa for recording their statements. Senior police officials said that complainant had said that the loan was sanctioned for the building project 'Vasanta Farms' in Bangalore but till date the building project had not come. The police are in process of collecting more details about the case. The loans were sanctioned during the tenure of board of directors between 1998 to April 1, 1999. The names of the former board of directors listed in the FIR are: chairman, R D Khalap, directors: Prabhakar Narulkar, Dharma Chodankar, Milind Kerkar, Motilal Bandekar, Manohar Sawant, assistant general manager, A P Punege and others. A senior official said that the inquiries were being made as to how the bank had extended credit facilities to the people residing outside Goa, when the clearance from the RBI for extending loans under the Multi-State Co-operative Act was not obtained. The police has recovered a letter written by the bank to the RBI, seeking permission to sanction loans outside Goa in view the bank getting a status of the multi-state co-operative institutions. Documented by Goa Desc Documentation Service circulated by Goa Civic Consumer Action Network (GOA CAN)[EMAIL PROTECTED] Ph:2252660 --- --- HC admits plea on Parrikar's insinuations against judges -- Congress spokesperson, Jeetendra Deshprabhu has approached the High Court praying that it institute suo moto contempt proceedings against the Chief Minister Manohar Parrikar for allegedly making a statement that judges were corrupt, and that it should direct Parrikar to disclose the name of the corrupt judge. When the matter came up before the double Bench comprising Justice F I Rebello and Justice P V Hardas, the Bench heard the petitioner and then fixed the matter for Wednesday to hear the Advocate General on the matter. The Bench also questioned why the newspapers had not been joined as parties as the remark was published in the newspapers.Mr Deshprabhu who is the Pernem MLA, has taken note of a newspaper report in the Herald dated June 30, 2003 which carried the headline Judges too can be corrupt: CM referring to a statement made by the Chief Minister at a public forum where the Taleigao parade issue was raised. The petitioner has also made a reference to a newspaper report of a press conference held on July 3, 2003 by Parrikar, where he has stated that he had a complaint against a judge that he had taken a bribe of Rs 5000 from a multi-national company to pass a favourable bail order. He however did not disclose the name of the judge concerned at the press conference, nor the nature of the evidence in his possession. Deshprabhu has submitted that the general allegation made that judges are liable to be corrupt has the effect of lowering the authority of the courts, and that the faith of the people in the judiciary would be undermined. He has also submitted that this statement constitutes criminal contempt as defined under the Contempt of Court Act. In this regard, he has urged the court to initiate suo moto contempt proceedings against Parrikar. Deshprabhu has also stated in his petition that if Parrikar indeed has evidence against the said judge, then he should have followed the procedure for reporting the matter and taken appropriate measures in that regard instead of issuing a public statement, especially in the light of his being the Chief Minister. The effect of an allegation of corruption against a judge, without naming him is likely to result in casting a cloud over practically every judge of the judiciary of the State, claimed the petitioner. He has therefore approached the Court praying that the court take notice of the petition and institute suo moto contempt proceedings against Parrikar for committing criminal contempt as defined under the Contempt of Court Act. He has also prayed that the court direct Parrikar to disclose the name of the judge against whom the allegation of corruption is made. (GT) 4-LANE POLEM HIGHWAY: Union Minister of State for Surface transport, Shripad Naik, yesterday stated that the consultants for the proposed four-lane 103-km long highway from Patradevi to Polem would be appointed soon and the work would begin in another 5-6 months. (H) SUB-STANDARD ROAD WORKS: The Margao Seva Association has demanded that the potholes on roads in the city should be filled immediately by the concerned authorities on day-to-day bias without waiting for floating of tenders after the monsoons. The Association has demanded that the contractors should be held responsible for sub-standard work of roads and held liable under the law of the land. The co-operation of citizens was also sought to reduce the plastic menace by re-using the same plastic carry bag over a period of time. Mr Sudhir Kandolkar, chairperson of the Mapusa Municipal Council said that the Council is considering the door-to-door collection of garbage in Mapusa if citizens co-operate and segregate their garbage in their homes. (NT) STRONGER RELATIONS BETWEEN UK AND GOA: The British Council in India is scheduled to inaugurate the Goa Chapter of the Association of British Scholars (ABS) on 29 August, according to Paul Smith. It is interesting to note that the use of ethanol for fuel has a similar political twist in the US as well. Some in the corn producing states of the US successfully pushed for increased use of ethanol in fuels in the US. Ethanol in its pure denatured form is safe to consume - it is basically pure alcohol that some on goanet seem to sip large gulps off, prior to posting on the net. The world leader in ethanol use used to be Brazil. In the 1970s, it attempted to have ethanol completly replace petroleum as its fuel of choice. Besides seemingly having a detrimental impact on Brazil's soccer performance for much of the 70s and 80s (and from which it has never fully recovered), it was also too expensive. As a result, they too have for the most part returned to using alcohol blends. While most agree that oxygenated fuels improve combustion (decrease ozone and carbon mono oxide), one still needs to wonder if this is really as good as it is cut out to be. For example, a lot of energy is used into growing the corn, while very little energy is needed to tap oil that literally gushes out from the oil fields of Saudi Arabia. Stated in other words, it takes more energy to produce less energy - otherwise, we would have had perpetual motion machines. Also, land that could potentially have been used for purely agricutural purposes is now being devoted to produce a rather expensive fuel, which to some, is a subsidy to the rich automobile driver. Another big issue, specially in India is the functionality of the emissions controls on old cars. Many countries require that their car owners re-certify their car emissions every couple of years.
