Personal liberty is paramount in constitutional values and in any civilised
conception of human rights; any law that makes bail difficult should
therefore be applied with the greatest care

Waging war against the government is a grave crime and it is expected that
the police would be as serious in proving it. What the example of G.N.
Saibaba demonstrates, however, is the State’s indifference towards the
procedure surrounding arrests and evidence under anti-terror legislations.
After being convicted under the Unlawful Activities (Prevention) Act, and
sentenced to life imprisonment for Maoist links, the professor, Mr Saibaba,
already in difficult health, spent a total of 10 years in jail together
with five others, one of whom died in 2022. The Bombay High Court has now
acquitted them on the basis of failures — not just flaws — of procedure.
The prosecution could not establish legal arrest and seizure of five
accused and the seizure of incriminating material from the professor’s
house. Proof of the electronic evidence according to the relevant laws
failed too. The sanction to prosecute under the UAPA that would follow the
review of the material against the accused by an independent authority was
invalid as well. Although this was a special procedure to ensure fairness
in rigorous, bail-scarce UAPA accusations, it operated as a mere permission
to prosecute. Even though the Bombay High Court discharged the accused on
this basis in 2022, the Supreme Court had stayed the discharge.

The details of this case reveal the way the State works when laws have been
weaponised against suspected dissenters and critics. No act, conspiracy or
membership seems to be needed for arrest under an anti-terror law, although
possession of literature relating to banned organisations cannot be reason
for prosecution. Even if there is sympathy, which having such literature
does not prove, it cannot be cause for prosecution. The State cannot
dictate thought or feeling. The police’s casualness in establishing
culpability indicates that incarceration is the goal. Personal liberty is
paramount in constitutional values and in any civilised conception of human
rights; any law that makes bail difficult should therefore be applied with
the greatest care. The professor and his co-prisoners have lost 10 years;
one has died and the professor’s health has been seriously threatened. Of
8371 persons arrested under the UAPA between 2015 and 2020, only 2.8% were
convicted, which exposes the attitude of the State. Thousands are still
waiting for a resolution. Would Stan Swamy have lived if bail had been the
rule and jail the exception?

overemphasis  of false pride being nutured on religious basis is
misplaced.   Every activity,  thought, expression is being looked upon thro
this imagined lense.The superiority of one religion is a myth
USA, a Nation composed of multiple and diverse identies  never for once
faulters to demonstrate national pride.All are united despite differences
of origin and religious affiliations. Politicians deliberately fan these
ideas of Nationalism to divide and rule and perpetuate their power ambitions
The building of temples ,destruction of other religious signs, religious
persecution  fanning conversions,propagating choice of food,  dress  is the
new  political strategy to win votes.With education caste factor is being
relegated as it is no more emotive issue.The spread of Hindu pride as core
of Nationalism is being exploited to the hilt and seems to appeal and
captivate masses.  state  formed on theicratic principles is not the best
model   in existence and democracy being disguised  to ape such  ambitions
is unacceptable
Oman which  Pope recently visited permits  freedom to erect religious
edifices and there are no conflicts as people professing different faith
live in peace and harmony
India must not descend into abyss  of fanatism of religious  intolerance

We,  citizens of Panjim, have been given little powers recently by the DGP,
to inform the Traffic Cell department for any irregularities found by the
vehicular traffic in the city.  This was informed through the Press
statement by the Director General of Police Mr. Mukesh  Chander.
Today, at 13:04 hrs on 21.11.2017 near M/s J.D. Fernandes a stationary shop
opposite to Garcia de Orta garden a vehicle bearing GA-03-R-4887 was seen
parked at Zebra crossing ( photo attached) which is just opposite the
M/s Vaglo shop.
This photograph is attached for information to the Traffic Cell for action
and maybe it is a testing mode to them whether any penalty will be imposed
for this irregularity.
In this connection, the citizens have very little power to penalize them (
defaulters).  Many times in Panjim either the two-wheelers ride at higher
speeds especially in Campal- Miramar  road upto Dona Paula above the
permissible speed limits even very high speeds. Citizens are not
equipped with any test equipment to read the speed as a supporting evidence
in case there is an argument in the court. Also, other traffic faults such
as  No entry, overloading, No driving license,  No documents, driving by
school children etc all these are not possible for the citizens to take it
up and provide photographic proofs and witnesses cannot be trusted.  I have
noticed many times the police traffic cops also when they see drivers
committing such faults they do not catch them, either they do not have
powers or not equipped with the challan books,  or they are not on duty.
although they are in uniform.
Therefore this system may not be feasible for the citizens Panjim to take
it up in full extent unlike in Delhi and other states where the system it
seems is working quite satisfactorily.

***It is good that we are giving chances to all medical systems. Let the 
people try for themselves and see what benefit they get. I favour integrated 
approach to medical systems. If 'allopathic drugs' can be tried on patients, 
why homeopathic and ayurvedic drugs cannot be used for the benefit of the 
patients? Our physicians are prescribing ayurvedic drugs for the patients 
with success. It is more difficult to prescribe homeopathic drugs without 
studying. But today there are patent drugs which can be used if you have 
some knowledge. Some 'allopathic' physicians are taking themselves 
homeopathic drugs for their 'incurable' diseases...  Let the scientific 
critical sense prevail while using any drug.

In a special year end issue tagged 60 revolutions, INDIA TODAY has a
write-up titled Moutful of Sky by one Malini Bhupta, probably a journo.
This is in contrast to many other similar ones by respected figures in the
respective industries. Her article is about low cost airlines.

She begins by the fairly legendary (perhaps mythical) story of how Air
Deccan began. For good measure she says Capt Gopinath convinced Delhi babus
to sanction two new airports  in Tier II towns like Hubli (KA) and
Vijaywada (AP). She goes on to say The government also slashed sales tax on
ATF from 80% to 4% and abolished landing and parking charges for small
aircraft. This may be to justify Air Deccan's claim to be a low cost (not
just low fare) carrier. But it seems she may be confusing and mixing up
central government with state government.

Then she says that till the entry of Air Deccan et al the industry was
stagnating at 8-10 million passengers a year. Today over 71 million Indians
fly within India every year. Deccan only enetered in 2003. An eight fold
growth in 4 years? That's a whopping nearly 70% compound annual growth rate!

Later she says From 10 million domestic passengers annually till (sic) 2002
to 71 million in 2007. the journey of Indian aviation blah blah blah.  This
works out to a more modest 48% p.a. But it still seems somewhat inflated. I
can go along with the 10 million in 2000 or 2001 but 71 in 2007 seems too
high.

What takes the cake are her references to Goa. With low cost carriers
flying into Goa, the tourism industry in the state has changed completely.
Today there's no such thing as 'off-season' ... Singh [of Spice Jet] says
'Almost all airlines have started flights or increased their services
between Goa and other cities... At last count only about 10 cities (out of
80 in India) are connected to Dabolim, to my knowledge. What is the journo
talking about?

From personal experience I can say Spice Jet discontinued  its
Goa-Bombay-Ahmedabad flight way back in March 2007. And while the
Ahmedabad-Bombay-Goa flight remained in operation, the one I travelled on
was terminated in Bombay (for technical reasons, though the plane seemed
very new) and we had to wait for a few hours for another flight from Bombay
to Goa. Other people also confirmed this practice of Spice Jet of pulling
Goa flights out, perhaps to consolidate the passenger load on fewer planes.
In one recent case a different airline cancelled its Ahmedabad-Goa direct
flight at the last minute and one had to re-book on the next day's flight.

The moral of the story: Take things from even reputed publishers with a big
pinch of salt. Another thing is, India is the undisputed world leader in its
air farce. Airline scheduling has taken on a whole new meaning out here.
