Make sure you get it all notarized. Even with that I would still
have him get a title and then transfer it to you. I think there
is a penalty to be paid because it wasn't titled in Fl right
away. Offer him $500 as is with the title the way it is or $2000
with a good Fl title.

Did they write in the current owners name in the title as the buyer to transfer
it to? If so he needs to get the title in his name. If the person is named on
the title now just signed it and the buyers space is blank, then all you have
to do is put your name in as the buyer.

Emailed Jerry and told him no with Florida title I was not interested

I had a similar issue with my 1962 300SE that came out of California. And all
I can say is that if you haven’t ever dealt with the CA DMV, you’re a very,
very lucky person.

I walked into the Florida tax collector’s office with a bill of sale and a
letter from the attorney who probated the estate the car came out of stating
that the car was a part of an estate they had power of attorney for the owner
and that they were conveying ownership to me. The folks in FL couldn’t have
cared less. No CA title - no title in Florida. Went back to the attorney who
told me “tough beans” and ultimately the State of CA. Essentially they said
that the only way I would get a clear title was to pay the 5-6 years worth of
non-operation fees and penalties (in person!) That was about $1800 at the time.
 Yeah.

I ended up paying about $500 to a company in Alabama that washed the title and
sent me a clean AL title in my name. Walked into the FL tax collectors office
the next week and walked out with a FL title and registration.

Yeah, this has all sorts of butthurt all over it. Florida isn’t going to let
him off the hook on this because they want their pound of flesh. You can do
“pass through” titles in Florida but only by dealers that I know of. Otherwise
you’ve got to title and register the car within the statutory time frame (30
days?) or the owner has to pay big penalties.

I don’t see how this guy thinks he’s going to unload the car without a valid
Florida title. Florida is a lot like CA in the way that it gets its claws into
the transaction whether you like it or not.

Re: [MBZ] Parts car for Kyle!

2017-03-01 Thread Dan Penoff via Mercedes
I’m not sure what Florida will do if there is no title. If the car was exempt
from a title in the Carolinas it might not matter. What’s going to happen is
that Florida is going to look up the VIN and see where it’s from and who’s
shown as the owner. If that doesn’t match what you have you’re going to have
trouble.

The alternative is to have the title “washed” by one of the title services you
see listed in Hemmings and other places that deal in classic and vintage cars.
It will probably cost you a good $1000 to do.

If you have the time you might want to call the tax collector’s office in your
county and talk to someone about it. If you go into the tax collector cold
you’re liable to come out without a title and be very unhappy.

Dan - been there, done that in Florida

Re: [MBZ] Parts car for Kyle!

2017-03-01 Thread Meade Dillon via Mercedes
When I bought my 124 cabriolet, it had been abandoned at a garage and the
tow truck guy (a retired cop) went through the hassle of getting a new
title issued. Here in SC the deal is the new "owner" sends a registered
letter to the last registered owner's address, I think the letter basically
says that if the registered owner doesn't respond in 90 days or some time
period, the state will cancel the old title and issue a new title to the
new owner. Once the 90 days are up with no response to the state, new
owner can get a new title issued.

Check with your local sheriffs office or municipal police, they may even
have the info online.

2017-03-01 Thread Kyle Arola via Mercedes
I am emailing with Jerry, the "almost" owner. Found out the title is in
the previous owners name from the Carolina's From a "couple" of years
ago. I am pretty sure if the original title was filled out correctly then
Jerry has to go to the DMV to get his title before he can sign it over to
me. But I may be wrong and perhaps a bill of sale will suffice? Anyone
know that for Florida?

I will see where this ends up but I am not happy about the title thing. I
certainly don't "need" a parts car yet, but I do wonder how many are really
left around anymore? How long until we can't find a parts car at all?

True it is in the middle ground.

I am contacting them this morning to have a chat about the wagon and maybe
have a look on Saturday morning.

bet it wouldn't take much to put her back on the road.
