Cherokee Law The Cherokee system was based more on responsibility for wrongful actions than on the notion of "justice" in the western sense of the word. Rather than justice, the Cherokee system was ideal for keeping balance and harmony in the spiritual and social worlds. "One day, some Cherokee children were playing outside, when a rattlesnake crawled out of the grass. They screamed and their mother ran outside. Without thinking, she took a stick and killed it. Her husband was hunting in the mountains. As he was returning home that night, he heard a strange wailing sound. Looking around, he found himself in the midst of a gathering of rattlesnakes, whose mouths were open and crying. "What is the matter," the man asked the snakes. The rattlesnakes responded, "Your wife killed our chief, the Yellow Rattlesnake today. We are preparing to send the Black Rattlesnake to take revenge." The husband immediately accepted their claim and took responsibility for the crime. The rattlesnakes said, "If you speak the truth, you must be ready to make satisfaction." The price they demanded was the life of his wife in sacrifice for that of their chief. Not knowing what else might occur, the man consented. The rattlesnakes told the man that the Black Rattlesnake would follow him home and coil up outside his door. He was to ask his wife to bring him a fresh drink of water from the spring. That was all. When the man reached home, it was very dark. His wife had supper waiting for him. "Please bring me some water," he asked her. She brought him a gourd from the jar, but he refused it. "No," he said. "I would like some fresh water from the spring." His wife took a bowl and stepped outside to get him some fresh water. The man immediately heard her cry. He went outside and found the Black Rattlesnake had bitten her and she was already dying. He stayed with her until she was dead. The Black Rattlesnake then crawled out of the grass. "My tribe is now satisfied," he told the husband. He then taught the man a prayer song. The Black Rattlesnake told him, "When you meet any of us hereafter, sing this song and we will not hurt you. If by accident one of us should bite you, sing this song over the person and he will recover." And the Cherokee have kept this song to this day." We had a strict liability law for any killing. The death created an imbalance which required revenge to restore harmony. The clan of the perpetrator of the homicide was to admit and accept responsibility for the wrongful killing. Then the clan was expected to pay the cost. Blood called for blood. Following this system, the husband sacrificed his wife's life to restore harmony. He did so because that was the law. In following the law, harmony was restored between the rattlesnakes and the humans. To reward the man, the snakes gave the humans a song to protect them and to remind the snakes of their duty to the humans, as well. The Cherokee religion drove the sense of balance, which created a moral system for the human to follow. What drove the revenge system was the sense of balance. When a delict was committed, it created imbalance and tension on the jurisdictional unit. The acceptance of responsibility and paying of the cost restored that balance. Once the balance was restored, the relationship between the jurisdictional units or clans continued as if nothing happened. There were to be no hard feelings expressed between family members of the victim or killer. Balance had been restored and any friction was to end with the restoration of balance. The creation of imbalance was tied to the Cherokee religion. It was believed that the murdered "soul" or ghost would be forced to wander the earth, unable to go to the next world. This created the imbalance. The acceptance of responsibility and the death of the killer or one of his clansmen restored balance by freeing the innocent ghost, allowing him to go to the next world. That is why it did not matter who paid the cost for the delict of the wrongful killing. Any death from the responsible clan would suffice to free the innocent man's ghost from this world. An enemy scalp might suffice as well. In international law, the Cherokee system worked much the same way. If an international delict occurred, then anyone from the that jurisdictional unit, in this case, the foreign nation, would suffice to pay the cost. Taking responsibility for the international delict and paying the cost were exercised in the face of swift vengeance. There was no time for contrition. Thus, interloping settlers took their chances by moving onto Cherokee territory, because they might be called to pay the cost for someone else's actions or the actions of their nation. For the Yurok, salmon is everything Posted: October 04, 2002 - 10:12am EST by: Barry Wayne McCovey Jr. / Technician / Yurok Tribal Fisheries Department I have lived within the Klamath River system my entire life. Im not very old, but Ive witnessed and experienced the river for twenty-four years. The river is an inherent part of me, and the lifeblood of my people. As a Yurok Tribal member and college student in the fisheries field, I spend my days working along the Klamath. The carnage Ive seen over the past week and a half is so utterly grotesque that I cannot sleep at night. I close my eyes and the images of dead, rotting fish envelop me. You may have seen photographs in newspapers or caught a glimpse on the television, but you cannot begin to imagine the smell. This smell of death and decay is impossible to escape. It fills the air and plays with the mind in ways that I could never describe. I cant eat because food, no matter what it is, reminds me of the smell. Perhaps its because the rotting fish represent so much of my peoples food gone to waste. The water levels in the river have never been in such decline. Numerous tribal and non-tribal elders have assured me of this fact. In my lifetime, I have never seen the Klamath so shallow. Over the past month, the lack of water has actually stopped the tribal fisheries program from completing tasks that were routine last year. There is so little water that people are unable to safely travel the river by jet boat or by raft. Ive seen rocks that I didnt know existed protruding from dangerous rapids, making the attempt to count dead and dying fish a risky endeavor. Yet even in its shrunken state the river humbles me and demands my respect. I am fortunate enough to spend time within its grasp and to be able to know and understand the power of the Klamath. For me, nothing is greater. Civilizations will come and go, but the river will remain. This I know. People will try to destroy it, to use it for hydroelectric power, use it to irrigate a desert, use it to get votes and push policies contradictory to natural laws. But the river will survive. All of the sickness and greed in the world cannot stop the river from its flow. In the not so distant future the worlds population will surpass the Earths carrying capacity. People will starve, become infected by disease and suffocate just like that salmon in the Klamath. This insanity will stop, and the river will rise. Unfortunately, the chinook, coho and steelhead salmon will not see the river rise. Just like the wild grizzly and wolf, these fish are being run out of California. Some would argue there isnt a problem because we can just grow new fish in the hatchery system, but that system, like many others in forced management, is flawed. The hatchery system has created fish of unknown origin. It is impossible to tell the difference between a hatchery born fish and native fish without extensive genetic studies. It is estimated that only 10 percent to 25 percent of hatchery chinook are marked for identification, and estimates of the native fish population estimates are very difficult to make. Arguments that dismiss the magnitude and future impact of this fish kill sicken the spirit. It may as well be said that Yurok people could just die off because other native and non-native people could easily replace us and thrive in our traditional homeland. Native fish, not hatchery fish, are the only hope for the future of the species. Without a doubt, the native chinook, coho and steelhead are endangered. Recent fish kill estimates in the Klamath have been conservative, but as many as 30,000 chinook, 600 coho and 1,000 steelhead are likely to be counted among the dead. These numbers may not sound like much unless youve witnessed the putrid, decaying fish kill firsthand. Washington bureaucrats, like Secretary of Interior Gale Norton, need to come to the Klamath and walk along the banks of the river with me. Perhaps a view of the carnage might lead them to see things differently. I personally invite officials from the Bureau of Reclamation and the Department of Interior to come and cut open the bellies of rotten salmon to detect their sex. I invite them to hack off fish tails in an effort to keep them from being recounted. I want them to realize there is no escaping the smell. The Klamath is everything to me. It is my home, church, garden, highway, counselor, friend, brother, and provider. Even in its depleted state, nothing on this planet could equal its beauty and its power. Secretary Norton has a rare opportunity to do something great. She has the power to reverse an incredible injustice. The Yurok people arent asking for all of the water in the Klamath, just enough for our most important resource to survive. Her job is not easy, and her decisions affect peoples livelihoods. But her decisions also affect generations of Yurok, Hupa and Karuk tribal peoples. Another fish kill of this magnitude could bring

The others are in Arizona, except for the Jicarilla Apache which are in North Central New Mexico. It is a shame that people are ashamed of thier heritage. They are living out of balance. It sounds to me she is living out of balance, which is the cause of her anger. She may have been treated badly when she was young, and unfortunately you cannot walk in her shoes. All we can do is pray to Creator for healing for her. Oh, Kris - what a wonderful story! I had no idea. Thank you so much for telling me about it. Quite a guy, our David, huh?? Ronni [EMAIL PROTECTED] wrote: ronni...david was fostered out when he was a week or two old..he wasnt expected to live because he had so many health problems..he was premature...all thru his life as a foster child, he was sickly...his foster dad refused to adopt him...he told me he never felt comfortable at the dinner table at home...no one looked like him! the Mexican kids in school shunned him, the white kids made fun of him...when he was 27 yrs old his foster mom gave him his baptismal certificate...his birth moms name was on there...to make a long story short, after he found her, he went to see her...she was in the hospital in Wyoming where she had moved, with Lou Gerhings disease..he only had 3 hours with her...she was so happy to see him! she told him she was Apache...they didnt get into his birth dad at all...she was too sick...the next day when he went back to see her, she had died overnight...anyway...thru much research and a lot of hard work, he found her family...they were Chirachua Apache and Isleta Pueblo...he got no help at all from Catholic Charities, or the Social Services system...he did it all on his own...his half brothers knew nothing of their Apache heritage...david has contributed all his info to the family name website and has helped many of his birth family find thier relatives and heritage..he is close to his cousins in New Mexico now, and his Uncle and cousins in Seattle...they really moved around..lol! he has applied to the Isleta Pueblo for enrollment and now the Chirichua/Mescalero nation also...the Chirichua live with the Mescalero on thier rez...last summer he got to go to his cousins home which his great grandfather and great uncles built a hundred years ago...an adobe house...still standing..where his cousin lives...he got to walk in the footsteps of his ancestors on thier land and visit his gg gramma's grave...it was a very spiritual experien! ce for him...Catholic Charities and other government agencies make it very very difficult to find your birth parents and family...Creator guided his footsteps for sure! now he knows who he is...and is so proud of his Ancestors and his heritage..his foster sister has disowned him for finding his heritage...he doesnt care...but it hurt at the time...david was not expected to amount to much...but he fooled them all...he has a Masters degree in Library Science, and two Bacholer degrees, in Geology, and History...he still has many health problems but is very active in Indian issues..he considers himself as Apache/Pueblo, and is so proud of his heritage..he is a real success story in my eyes...to never give up trying to find your relatives! they are waiting and willing to help you if you only ask..Kris"All things share the same breath..the beast, the tree, the man; the air shares its spirit with all the life it supports."Chief Seattle Visit and show your support for the Grass Roots Oyate http://members.tripod.com/GrassRootsOyate Clemency for Leonard Peltier. Tribal elders and chanting drummers led the groups on the Four Directions, All Nations March that culminated at Broadway and Colfax. Aztec dancers flourished colorful, feathered costumes and danced the "Tonantzin," a ritual for unity and peace. The deep thump of more rhythmic drumming and traditional song propelled protesters to the steps of the Capitol, where speakers addressed a wide array of causes. Some lashed out at the colonialism they link to Columbus himself, while others focused on everything from impending war in Iraq to the Palestinian situation to endangered old-growth forests, just a few of the issues they define as the "Columbian legacy." One 22-year-old woman who called herself Xylem, after the woody tissue that draws water into plants, said she'd traveled two days by bus from Oregon, where she volunteers for the Cascadia Forest Alliance. "I'm Italian," she said, "but we can celebrate without celebrating genocide and ecocide." A few blocks away, a stream of limousines, horse-drawn carts, floats and marchers readied for the parade, which was scheduled to begin hours after the Indian procession. "First of all, it's about freedom of speech," said Raffaele Vitale, who emigrated from Italy 32 years ago. "But it's also about my roots, my heritage." The event began without confrontation, but protesters met the parade at 17th and Tremont streets. About a block farther on, a few tried to breach the barricade but were quickly repelled by police. The procession played out to a few groups of well-wishers and persistent verbal volleys from protesters. Some chanted - "Celebrate your pride, not genocide!" - and saw their words met with waves and smiles. A few in the parade fired back at several protesters who had covered their faces with handkerchiefs or ski masks: "Why don't you show your face?" The Italian-American celebration moved along to the snare-drum cadence of Westminster High School's marching band, which belted out a rendition of "Louie, Louie" while a few roving vendors hawked American flags, horns and cotton candy. As the parade approached the main protest area, double-barricades and police in riot gear discouraged any close-range interaction between the two sides.

The area I live is beautiful country, lots of hills, caves, s many of the wonderful creatures The Creator has blessed us with to learn from and enjoy. I am familiar with the area around Cinn. due to traveling, but have not spent any time there.
