[PAYCO] TRIBUTE TO THE LATE ISAAC SAKI MAFATSHE FROM DEPUTY CHIEF JUSTICE DIKGANG MOSENEKE
TO: THE FAMILY OF CDE ISAAC MAFATSHE , OTHER MOURNERS AND COMPATRIOTS I write this tribute to Comrade Isaac “Sakkie” Mafatshe with a heavy heart. I gathered on Tuesday afternoon that UmAfrika Sakkie had left us after a period of brief illness. The reality of his departure dawned on me when I visited his home yesterday to pay homage to the family. He has indeed passed on. I grew up with Sakkie in Atteridgeville. We are of the same generation. He was only two years older than me. Whilst at secondary school we gained political consciousness together. His intellect surprised me. In the early 1960’s at the ages 13 and 14 he had started reading The Africanist a mouth piece of the Pan Africanist Congress and New Age a mouthpiece of the African National Congress. He talked about the Chinese revolution and about Cde. Maotse Dong. Together we attended political ideology classes at Cde Ike Mafole’s home in Maraba Street and Cde Jafta Masemola’s residence in Tlale Street. We were together arrested by security police in the dawn of Sharpeville Day, 21 March 1963 for activities of the Pan Africanist Congress. We were tried together with 14 other activists in the Synagogue and he picked up 10 years imprisonment as myself and UmAfrika Mark Shinners. As it is well known, in the same trial. Uncle Jeff Masemola and John Nkosi were sentenced to life imprisonment. On Robben Island, Cde Sakkie continued to amaze with his gift to debate difficult ideological issues of our struggle. He then cared little for formal education but chose deep self-education by reading progressive writing particularly on revolution and how to establish a just and equal society. He carried imprisonment with fortitude whilst his conviction as an Africanist became even deeper. Se se sa feleng sa hlola! Ten years on Robben Island came to an end. On his return, Sakkie’s family had left Atteridgeville for Mabopane. He chose to advance the struggle in exile where he assumed a leadership role immediately on arrival in Tanzania. UmAfrika Mafatshe was a revolutionary of a high order. His tenacity and the will to destroy apartheid and colonial oppression was amazing. His bravery knew no limits. As we all know, the PAC infiltrated him back into the country in the late 1970’s to re-awaken underground structures of the PAC within the country. That was a very risky assignment. He carried it out and left the country before he was napped by the security forces. He was a remarkable Azanain whose contribution to our long and arduous struggle we must celebrate and must not be in vain. Robala ka Kagiso , Mafatshe. Cde Willie Siyaya Nkonyeni will be laid to rest on Wednesday the 2nd April 2014. The funeral (FULL MILITARY FUNERAL) will be held at the Dlamini Community Hall (Old Vista), Koma Road, Soweto. Proceedings will start at 8:00 - 11:30. Echoing mmAfrika Fikiswa, events will take place, whether those that think they can make a difference partake in PAC events or not. Interesting how many, who rubbished the Butterworths Congress are the same people who have all the solutions to PAC's problems from the comfort of their lazyboys (couches). The PAC has indeed groomed a multitude of professional fault-finders who seem to master name calling, with some not even belonging to a structure or attending a single PAC event. The Marikana leadership came to an event/rally hosted by the Tshwane PAC Region in their honour a few weeks back and they requested that we assist them in establishing a branch there. We support all initiatives that make the PAC visible, what is of utmost importance however is that the PAC needs structures. The West Rand was one of the strongest bases the PAC had in the country, with many leaders and APLA cadres from that area. The fact that, Blacks look like human beings and act like human beings do not necessarily make them sensible human beings. Hedgehogs are not porcupines and lizards are not crocodiles simply because they look alike. If God wanted us to be equal to the Blacks, he would have created us all of a uniform colour and intellect. But he created us differently: Whites, Blacks, Yellow, Rulers and the ruled. Intellectually, we are superior to the Blacks; that has been proven beyond any reasonable doubt over the years. I believe that the Afrikaner is an honest, God fearing person, who has demonstrated practically the right way of being. Nevertheless, it is comforting to know that behind the scenes, Europe , America , Canada , Australia -and all others are behind us in spite of what they say. For diplomatic relations, we all know what language should be used and where. To prove my point, Comrades, does anyone of you know a White country without an investment or interest in South Africa ? Who buys our gold? Who buys our diamonds? Who trades with us? Who is helping us develop other nuclear weapon? The very truth is that we are their people and they are our people. It's a big secret. There is always strength in principled unity. Principled in that it is based on a programme to achieve the noble ends of freedom for the African people. Principled because it is simply founded on the ideal seeking to totally empower the poor to emancipate themselves from continued socio-economic pauperization. Principled in that it focuses on mass action rather than sectarian or elitist crusades. Accepting that nobody, party, social movement, group or faction has exclusive rights to some magic liberatory wand, revolutionary pluralism seeks to forge partnerships and networks for the empowerment of our people through the masses' own revolutionary action. Factionalists, informed by their petit bourgeois aspirations and arrogance, appropriate to themselves the right to think for the masses. When the masses inevitably ignore them, factionalists continue relentlessly to demonise all those who differ with them even inside their own parties or movements. This arrogant conceit eventually suppresses all progressive discourse and activism, ejecting potentially revolutionary innovations and capabilities. This type of destructive factionalism is rampant in many political parties and social movements throughout the world. In periods of revolutionary lulls and reaction, it always rears its ugly head. In the current neo-liberal triumphalistic epoch, it manifests in South Africa through the inexorable fragmentation of the revolutionary left. This is because petit bourgeois opportunists always lose focus of the masses' aspirations, and obsess in replacing one enstranged and lost leadership by another, in an endless vicious cycle of factional fratricide, perpetuating the continued pauperization of the very masses they claim to represent. We need to remember that in essence, both rightist and ultra-leftist tendencies and their numerous factions are melancholic expressions of forsaking the masses. The cure therefore can only be to reconnect to the masses. Only such a revolutionary programme can unify the fragmenting revolutionary left and parties in South Africa. It is time to put an end to the sectarian approaches to revolution, and to build networks and partnerships in the masses. As the crucible of struggle smoulders on, it is critical for the South African revolutionary left to refocus their energies on synergising their actions, experiences and knowledge acquired during this period of reaction. We must start realising that continued accentuation of differences and the negative is essentially reactionary as it inevitably prolongs the struggle and confuses mass political consciousness. We need to focus on the objective of a socialist democracy, through participatory action in the masses. Let all the hundred flowers blossom, cross-pollinating towards the ideal of proletarian power. Let the differences be transformed into rich innovative approaches of revolutionary pluralism. Let us integrate the rich experiences and knowledge derived from the struggle, into a consistent revolutionary programme for the self-emancipation of the Azanian masses! Remember Africa!! They were there when the oppressed African people needed them. The war waged by APLA and its forerunner, POQO was a continuation of the wars of resistance waged by our forefathers against foreign encroachment and usurpation of our land over four hundred years ago. We should celebrate the twelve heroes of Operation Crusade who did battle with Portuguese forces around Vila Peri in 1968 in Mozambique on their home-going programme. They were Gerald Kondlo, Samuel Madodana Guma, Oscar Ntoni, Qhasana, Menzeleli, Twala, Bele, Enoch Zulu and Zeblon Mokena. We must also pay tribute to the more than a hundred POQO cadres most of whom were hanged in the early 1960’s and those who were jailed on Robben Island. Not much is known about these POQO/APLA heroes in Azania. We know that history is written in the corridors of power. However, it is our duty to inform the people of this country about these heroes. This information must be recorded in the annals of this country’s history for posterity. The operations of APLA during the 1970’s, 1980’s and 1990’smust also be celebrated. Our detractors might say why we celebrate since some people lost their lives while others lost their limbs. My answer is that war is ugly. Moreover, we didn’t initiate it. As we celebrate the successes of APLA, we must also do some introspection. Cadres who took part in Operation Crusade were the cream of APLA which included their well-trained Commander, Gerald Kondlo. Some argue that it was a mistake on our part to have sent the cream of APLA on a mission that saw ten of them killed. We should have sent other cadres instead. Others counter by saying the PAC believed in leaders being in the fore front. With the benefit of hindsight, could we have done things differently? Many people expect that we must have learnt from our exile experiences how to resolve organizational problems such as factionalism and blind loyalty to a leader. What has brought us together is our belief in what the PAC stands for. People are difficult to lead and have different perspectives on and approaches to different issues. Therefore, there is bound to be disagreements in any organization because some people believe that their perspectives and approaches are the best while others also believe that it is their perspectives and approaches that are the best. When a situation such as this arises, we should always look for those things on which we agree and thereafter attend to those things on which we don’t agree or discard them. It is how leaders manage disagreements and conflicts that will keep the PAC and its formations united. Many people like to emulate the leadership style of our founding President Mangaliso Robert Sobukwe because he was altruistic and selfless. This is also true of the second President of the PAC Zeph Mothopeng. LEADERSHIP What constitutes good leadership? Is it to be elected in Polokwane or at any elective conference? The term leader conjures up the image of an exemplary figure; of someone who can help others set goals and achieve them. It also implies the capacity to control, shape or direct an entity, an activity or a process. This capacity requires creative and imaginative thinking, innovation and entrepreneurship. Leadership has to be defined in terms of driving or motivating an organization, a state, a government or any group to achieve something. It is the ability, willingness and commitment to mobilize and utilise the best resources, operational skills and techniques available to attain a given goal or resolve a problem. In other words, good leaders must demonstrate a commitment to seek the best means, or make the necessary sacrifices to pursue the goals that they have set or provide a solution to an existing problem. They should also be able to motivate or inspire their constituents to pursue their goals with confidence. Another problem is that we are net consumers of knowledge than producers of knowledge. [PAYCO] Minister of Correctional Services, Hon. NN Mapisa-Nqakula, MP, to Consider Additional Categories of Offenders Serving Life Sentences
On 25 July 2011, the North Gauteng High Court delivered judgment in the matter of CJ Van Wyk v Minister of Correctional Services and others (case number 40915/10), the case related to the consideration of offenders sentenced to life before 1 October 2004 and the minimum time served prior to being eligible for consideration for placement on parole. Since the coming into effect of the 1998 Correctional Services Act, offenders sentenced to life incarceration before 1 October 2004 had to serve a minimum detention period of 20 years before being eligible for consideration for placement on parole. However, the North Gauteng High Court found that sentenced offenders have a right under our Constitution to be sentenced in terms of the least severe punishment applicable at the time the offence was committed and that the new Correctional Services Act of 1998 could therefore not treat offenders harsher than the system applicable when they committed the crimes as per the dictates of the 1959 Act. The net effect of the Van Wyk judgment is to change the minimum detention period for offenders sentenced to life before 1 October 2004 prior to being eligible for consideration for placement on parole. The Minister of Correctional Services, Hon. NN Mapisa-Nqakula, has studied the judgment and developed an implementation plan to give immediate effect to the North Gauteng High Court's ruling. In summary the court has ruled as follows: That the applicant (an offender sentenced to life before 1 October 2004) and other offenders who were serving sentences of life incarceration immediately before 1 October 2004 are entitled to: a) Have the date on which they may be considered for parole advanced by credits earned in terms of section 22A of the Correctional Services Act, 1959, subject to applicable criteria for the allocation of credits. b) Be considered for parole in terms of the policy of the Department of Correctional Services which applied at the date of the commission of the crimes for which they are serving life imprisonment. The credit system was indeed applied within the Department from 1 August 1993 to 30 September 2004. In order to implement the judgment without unnecessary delay, the Department of Correctional Services has taken a decision based on a number of considerations that: 1. To grant all lifers sentenced before 1 October 2004, the maximum credits that a lifer could have earned under section 22A of the 1959 Act. 2. That the minimum detention dates for offenders sentenced to life before 1 October 2004 will therefore now be calculated as 13 years and 8 months. It is, however, important to note that these offenders do not qualify for parole but merely qualify for consideration by the Minister of Correctional Services for placement on parole. Since all lifers sentenced up to 1 March 1994 are being considered for placement on parole at present as a result of the Van Vuren judgment handed down last year by the Constitutional Court, it means therefore that the Van Wyk judgment and the new minimum detention periods for lifers apply to all those lifers sentenced as from 1 March 1994 up to 30 September 2004. According to the Department of Correctional Services' preliminary audit list, the totals are as follows: Sentenced as from 1 March 1994 until 31 December 1997 (the last of these completes the 13 years and 8 months minimum on 30 August 2011) who must be considered as soon as possible: 361 Sentenced as from 1 January 1998 until 30 June 1998 (they will qualify within the next 6 months - after 30 August 2011): 41 The rest who will benefit from earlier considerations are (sentenced from 1 July 1998 until 30 September 2004):4267 This judgment must however not be understood to mean that any inmate sentenced to life incarceration before 1 October 2004 has a right to be placed on parole or day parole. All this judgment intends to facilitate is that inmates sentenced to life incarceration during different periods when different legislative and policy provisions applied have a right to be considered for placement on parole after having served the minimum detention period applicable to their specific circumstances. One of the most disappointing aftermaths of the South African liberation struggle and the so-called 1994 'revolution' has always been the relentless manner through which African people were robbed and continue to be robbed of their inalienable heritage, be it the country of their forebearers or the recognition of their toil through which they overthrew white domination in this country. This has recently manifested through machinations to use President Mandela's name to dispossess African people of their heroic liberation history that we continue to live. Some tell us to be thankful to President Mandela for the overthrowal of white domination. Pres Mandela himself knows that such suggestions are an insult to the blood shed and lives sacrificed during the heroic resistance wars and liberation struggle since 1652. Frantz Fanon cautions us: To educate the masses politically does not mean, cannot mean making a political speech. What it means is to try relentlessly and passionately, to teach the masses that everything depends on them; that if we stagnate it is their responsibility, and that if we go forward it is due to them too, that there is no such thing as a demiurge, that there is no famous man who will take responsibility for everything, but that the demiurge is the people themselves and the magic hands are finally only the magic hands of the people (1968.) We all need to tirelessly assert ourselvels and celebrate our accomplishments as a people, in order to further rededicate ourselves to current and future challenges. The Azanian people were their own liberators and shall emancipate themselves once again from their continued soio-economic pauperization. This can only be achieved when Azanian people and their true leaders strive for non-partisan, non-sectarian revolutionary unity accross the board, to rally behind the historical mission of the working class: that of establishing a socialist democracy through which the poorest of the poor can be empowered. Thus empowered, the shackles of socio-economic pauperization would be shaken away! This should be the mission of any political party, social movement or trade union worth their salt. Some of them including Bonginkosi Mchunu in the new Kimberley Prison, arrested in July 1991 has since lost all family members.
