[RollTideFan] Further proof this country has gone nuts

2005-07-07 Thread Pat Smoot

He grabbed girl's arm -- now he's a sex offender

July 1, 2005

BY STEVE PATTERSON Staff Reporter

Fitzroy Barnaby said he had to swerve to avoid hitting the 14-year-old Des
Plaines girl who walked in front of his car.

She said he yelled, Come here, little girl, before getting out of his car
and grabbing her by the arm.

He said he simply lectured her.

She said she broke free and ran, fearful of what he'd do next.

In a Thursday ruling, the Appellate Court of Illinois said the 28-year-old
Evanston man must register as a sex offender.

While acknowledging it might be unfair for [Barnaby] to suffer the
stigmatization of being labeled a sex offender when his crime was not
sexually motivated, the court said his actions are the type that are often
a precursor to a child being abducted or molested.

Though Barnaby was acquitted of attempted kidnapping and child abduction
charges stemming from the November 2002 incident, he was convicted of
unlawful restraint of a minor -- which is a sex offense.

'Most stupid ruling'

Now, he will have to tell local police where he lives and won't be able to
live near a park or school.

This is the most stupid ruling the appellate court has rendered in years,
said Barnaby's Chicago attorney, Frederick Cohn. If you see a 15-year-old
beating up your 8-year-old and you grab that kid's hand and are found guilty
of unlawful restraint, do you now have to register as a sex offender?

But Cook County state's attorney spokesman Tom Stanton said Barnaby should
have to register because of the proclivity of offenders who restrain
children to also commit sex acts or other crimes against them.

In the criminal case against him, Cook County Judge Patrick Morse said that
it's more likely than not Barnaby planned only to chastise the girl when
he grabbed her, but I can't read his mind.

I don't really see the purpose of registration in this case. I really
don't, Morse said. But I feel that I am constrained by the statute.

Recognizing the stigma that comes with being labeled as a sex offender, the
appellate court said it is [Barnaby's] actions which have caused him to be
stigmatized, not the courts.

Extending Shula was right move

Judging by what happened on the field over the last two years, a good
argument could be made that Alabama football coach Mike Shula didn't
deserve the one-year contract extension he received earlier this week.

Despite all that, Alabama officials made the right call in extending

Not necessarily. I really don't believe Witt will allow

Shula will be in trouble with another 6-6 year.

Personally, I think we have a good chance of beating the barn the

Coachspeak meets public speaking

By MIKE KNOBLER
The Atlanta Journal-Constitution
Published on: 07/06/05

Like an Alabama running back looking for an opening in the Auburn defense, Mike
Shula stared out at the 1,200 people gathered to hear him speak.

He spotted an opening, or so he thought, and decided to take his first question
from a 9-year-old boy in the front row.

Hey, Coach, the kid asked, as serious as Alabama's back-to-back years without
a winning record, are we going to do anything else this season other than run
it up the middle?

Luckily for Shula, the Tide Pride crowd laughed, easing the tension for
everyone but the 9-year-old. Shula survived. One public appearance down, 40
more to go from New Year's Day through the start of practice. [...]

back when we were playing Da Pigs. Both their receivers fell down on a 4th
and ten and we got flagged. They marched down the field and beat us.

Is anyone else looking forward to instant replay?

If that's the game I think it is, it was the exact same season that BAMA
pulled out a win because freakin VANDERBILT got the bad call.

I ain't real sure what to think about the instant replay rule. I've always
been of the belief that things kindly evened out. I certainly might be wrong.

Bama has been on the dirty end of the stick more often than not. Maybe I am
just wearing Crimson colored glasses. So sue me.

Yeah, I agree. I seem to remember the same type of situation a few years
back when we were playing Da Pigs. Both their receivers fell down on a
4th

and ten and we got flagged. They marched down the field and beat us.

It seems to me that we've been an emotionally weak team since Coach
Stallings retired, excepting maybe the 1999 and 2002 seasons. Otherwise
we seem to look for excuses to lose rather than making the plays that
win. I shirley might be wrong ($1).

I don't really care about IR one way or the other. They'll still find a
way to screw us.
