I disagree -- this is indeed a bug.

If it's not possible to upgrade the kernel, that's fine.  But in that
case, the kernel version should be locked for live CD / live USB
bootups. (e.g. in Synaptic via Lock Version in the Package)

Currently, sudo apt-get upgrade is forever broken, because it always
tries  fails to install the kernel update. This is a huge turn-off for
anyone trying out usb-creator-built persistent USB installations.

Daniel, I agree with you and disagree with my previous comment. Due to
the number of users experiencing this issue, this is indeed a bug. From
a user point of view, the upgrade should be locked or at least should
not fail if the package is not upgradeable.

Since my aforementioned comment, bug 292159 has been chosen as the
master  report, and all other report will be attached to this one.

Thanks for reply---I'm running as Live because 'umenu.exe' failed to install to 
my HP Pavilion a530n, giving error message 'No initrid found. Try passing init: 
bootarg'this command was not recognized.
