In other words, if these companies have a consistent track record, the request should be assumed accurate. If a company is doing poorly say a 60% (might be too low) accuracy or less then peer review would seem a fair addition to the process before a takedown occurs. One net result: Even if critical speech / thought abides by all terms of Fair Use, DCMA terms chill the critical voice. But only if the critical thinkers allow themselves to be chilled. I believe Fair Use *is* in fact in the copyright statute. The problems: it's a subjective call due to the weighing of factors necessary (and if those factors were replaced by a specific and stringent test it would probably NOT be a good thing - I doubt the transformative clause would survive, and it is absolutely key), and unless they can persuade the EFF or the ACLU you to help, the independent artist or media maker is up against corporate-funded take-no-prisoners legal teams when it comes to proviing their case. I wish the law could be more specific, but what I'd want to see would never pass: a law that frames the issues solely as fraud and piracy, of whether or not the use deprived the copyright owner of sales or rentals by making the public think the copy was the actual item or by explicitly pirating the work as is. Period. The point of copyright should be to prevent false claims of authorship and to prevent outright fraud, and that should be IT. That's what it was for to begin with. Hey Matt, Couple of things: You can't own an idea so they couldn't have stolen yours. Also, I doubt its anything more than a coincidence. It looks like it's been developed by an outside production company and CBS bought it. I don't think they typically do those things on the order of weeks - it's more like many months. I bet there was some kind of fuckup in the chain of things, and they replaced the sound with Jan's originals for the archived post to the website. I know she records her work directly on her equipment (digital recorders with harddrives) -- so that would have given them a second chance to make it sound good. Hey Matt. I'm the guy that told you when you were pitching this @ the videoblogger meetup @ Rocketboom studios that you needed to hit the streets and practice videoblogging every day so you'd have an idea IF it was feasible for you to take the show on the road. First of all, let's not forget that Ze Frank did Human Baton a lng time ago: http://www.geekentertainment.tv/2006/12/17/running-fool-is-the-human-baton/ That got way more press and hype than your videoblog did and was started way before, so if they're copying an idea, it's probably Frank's. Second, that's what happens when your concept requires sponsorship. You asked us at that meeting if we thought you could get sponsored and start your trip within three months. The only way you were going to have any chance of doing that would have been to tell EVERYBODY what your plan was, way before you had the ability to implement it yourself. This is why when people are pitching something in the MSM world, they can be your best friend and NOT tell you what they're pitching, because the first one out of the gate with the product gets the credit for the concept. On top of that, CBS obviously has the funds to 'cheat'. They can afford to pay people to take in their traveler. They can also use the clout that whomever hooks him up will be seen on CBS or an affiliate or website. People will help out just to be on local or national televison. So... Forget about competing with MSM in their own arena. :) Interestingly enough, Kfir just made a post about the same thing. Take the advice of the people who have suggested that you leverage your DIFFERENCES from the MSM approach as an independent videoblogger and do your trip anyway, with your own personal style. You might actually get lucky and people might be MORE receptive to your idea now that they can see something EXTREMELY SIMILAR (if not the exact same thing) playing out in front of their eyes, sanctioned by MSM. This isn't the music industry. You can't mail yourself a copy of your concept in a sealed envelope and take that to court to prove that you ame up with the idea before CBS did. I've cut pilots for reality shows that never saw the light of day. That doesn't mean that some production company that watched the pilot and passed on it isn't going to turn around and do their own version of the exact same concept. [videoblogging] Any developers interested in making a DIGG this Podcast FeedFlare?
I just thought I would put this out there in case there is a developer listening that might like to take this on. Feedburner has a Feedflare API that allows you to add little functions to your feed items. One of these items is Digg this, which submits that particular item to digg. Thats fine for news items, BUT Digg has this separate Podcast directory that picks up items off an RSS feed and automatically lists them as they become avaiable. You can Digg an entire feed (or Podcast) or you can digg individual items in the feed. Either way, as far as I can tell there is no Feedflare that allows you to Digg an item thats already listed in the Digg podcast directory. The Digg flare that I can find will only submit the item as a new news item. So not being a developer myself, and knowing that there are some on this list. I was wondering if maybe some of you might consider developing such a thing based on the Feedburner API. Back in the dot com bubble Guy Kawasaki was always banging entrepreneurs over the head to realize that if you have an idea, you can guarantee at least five other people have it too. Success is in the execution and I love that GreenTV says the coopetition has actually helped them. I would contact CBS and see if they want to turn theirs into a portal type of thing and bring in your show as a correspondent or support channel, and look for other independent producers to really make it a bigger deal for all. I think this is an unintended consequence of all of us being so well-connected via the internet - we really are closer to each other in thought than is physically apparent ot than was possible 10 years ago. Bill - You are so right. It's so true. Ze Frank's human baton was definitely the original. Sometimes I forget that. I actually emailed him when I first was thinking about it and got some of his thoughts. I suppose I was talking about the fact that I felt the rules I set forth were copied to a T. It's so funny. I really don't want to do anything about it in terms of saying anything to press, but I suppose it does make me feel bitter toward CBS. Grrr. Still, the reason I ask if I should do anything about it is because frankly I really don't want to. I'd rather not get involved and continue on with my project. So, I think that's what I'm going to do. I just need to get the message out that corporate sponsorship is not necessary for this sort of thing. By the way, I have gone daily (at least for right now). The daily videos are turning out to not be as big of a challenge as I expected. I am trying to create a video in each location I go to. But, we'll see how long that lasts. Hello, Yeah... Verdi is correct... you can't steal an idea. Stealing requires you to (literally) take away, that thing they are stealing, away from the person who owns it. It's not possible to (literally) take away an idea from someone. You still have it in your head. You could say they copied you though. (Although copying is a form of learning... and isn't a bad thing IMO. Despite how much it might suck for you.) Although... unfortunately... the USA does let people have monopolies on ideas. (And has made actual thought crimes.) USA Patent law and the DMCA now each give this. But even in these cases... it is NOT stealing. It is called infringing. I don't think this email list is marketing anything. ? This list - while we do at times go off on long and fervent tangents - isn't necessarily a recap of all the topics being discussed out there in the vlog-o-sphere. The youtube video is (as youtube videos often are) a good example of internet video giving power to the people, and just because this list isnt a flutter about a given topic doesn't mean that nobody is out there using video to get that message out. After all people can be champions of giving a voice to the voiceless even if they themselves don't speak up on every single issue worthy of a voice in every medium possible. Especially now that youtube is so big ... I don't know that is fair to try and judge if video is getting the word out about some given topic based on the actual discussion of that topic in this list - or even by videos published by the (now comparatively small number of) producers that do in fact frequent this list. Also ... I've been on a low information diet lately so I've fallen behind on the discussions here, but it seems to me alot of the stuff we used to talk about here has moved to places like twitter. Anyway ... I'm not saying the topic isn't deserving of alot of attention ... but I'm not sure content discussions in this list is a fair representation of how much attention its getting within the online video community ... and thus shouldn't condemn this list to be categorized as marketing fluff. Back in the dot com bubble Guy Kawasaki was always banging entrepreneurs over the head to realize that if you have an idea, you can guarantee at least five other people have it too. Success is in the execution and I love that GreenTV says the coopetition has actually helped them. Another VC saying is: if you're the only one that has the idea...it's probably not a good one. As aeveryone is suggesting...the CBS show will probably help you. If it generates any news coverage...your project will be mentioned right there as well. and you can do it much more intimately and raw than CBS can. they are doing it as entertainment. you're probably doing it more for the experience. thats what i want to see. Hmm... I have talked to my library a time or two about creating issue casts - you know, go bug all the local mayorial candidates, ask them to talk about one issue for 1-2 minutes, then schmush them all together into one video, and put it up on our library's website. Cool way to be fair politically, lets our library be a community gathering place for commentary, etc.. but we've just talked about it so far! My opinion: Most people cant easily verbalize how they feel about political issues. we've all grown up being apathetic or feeling helpless about politiics. This is why there arent more innovative political videos. You have to have a clear vision to make it real in video. Or you need to have grounding in the issues. other than being on some email lists, how many people go to weekly political meetings...or volunteer for issues? if you do, then this would be where I would start. In agreement with Verdi, although you can not own an idea, yours is original and as unique as you can make it. Here are two suggetions. First, You could do your films and keep them delayed, so that if someone is copying you, then by withdrawing your productions, they are on standby. As mentioned approach another network, if you want, show them the first few films, then let them know you have the rest available ready for uploading, but need an agreement. Again that is if you want to go down that road. Second, in order to make your films different, look at other productions, pick out what you don't like and complain about them. That is what I do, not complaining as such but pointing out the flaws of other arguments. As everyone stated, keep going cos you are doing something very educational, interesting and different. I've just posted a number of videos from folks who are telling the story from their own perspective. That is what we all have been collectively working toward. We now have the ability to compare and contrast what is being said about a particular situation. I don't need Jesse, Al or anybody else standing and speaking when I can watch and listen from the grassroots level. This is tool cool. Did you feel it, the shift? This is real life, not an so called comedy routine. Folks are doing what the technology allows them to do, express an opinion about a current event that impacts a segment of the American population. Ding! Ding! Ding! Freedom of Speech, Expression and Right of Assembly. More videos will be posted and not all of them are going to be ripped off of NBC, CNN and other news sources. We don't give equal weight to injustice. We pick and chose what we feel is important. I watched a gentlemen on the news and he said in short ,it's shouldn't be looked at as a black or white thing it but an American thing. We should be all up in arms. Anytime one American citixen liberty is at risk of being taken away we all loss. Democracy becomes a running joke and we look like fools pretending like its antthing else but that. If they come after one segment of the population do you think they will stop there. It's like the rolling snowball down a hill. It's history repeating itself like in Bill Murray movie Groundhog Day. Things have reverted back to semi pre-civil rights attitudes and conditions.
