Yes. As I mentioned in another post, I put in a DMCA takedown notice
with his host and the site was shut down within 10 minutes. I'll do
the same with this new host if it's my site he rips off again.

I am just checking and seeing that the contact listed in the WHOIS
record is completely false. I'm a bit involved with ICANN through my
work with the Internet Society - I'm going to check if there's
anything can be done to suspend the domain, though I'm doubtful.

Certainly it's surprising to find your whole site copied - especially
in that way - but I don't think it's a complete disaster when stuff
like that happens. For myself, I'm mostly interested in making things
and having people watch/use/whatever. Someone copying my content
doesn't hamper those goals and it may even help a bit. Also,
everything is branded in a way even if it's just with your face or
url. And because it's copying not stealing, nothing is really lost -
probably not even ad revenue. All of that said, what I'd mostly be
worried about is Google - either having the copy show up in results
instead of the real thing or having Google remove you from their index
(not sure if they'd do that though).

Good to hear that you resolved this.

Interestingly, video blogs should be particulatly good at preventing things
like this.

Scraping and subsituting text is relatively easy, but dynamically altering
the content of a video/audio stream is _much_ harder. Maybe what we should
all learn from this is to include a bit more personal placement in the
videos themselves.

I'm not talking in your face here, but (for example) if you were to
hand-write your eevblog url on a piece of card and stand it somewhere on an
often-visible bench or shelf in your lab, it would be virtually impossible
to remove from your videos, especially if you occasionally change the
colour, shape, or handwriting.

That, together with the occasional mention of your site while you are
speaking to the camera should pretty much ensure that attempts to scrape
your site will be pointless.

Let's use the tools we have, and spare a moment of pity for poor text
bloggers who have no such defences :(

This is not uncommon. It's a splog essentially. Just haven't seen it done
in awhile.

You're on the right track with DMCA.

Don't freak out though... they're not hurting you directly... not like your
blog getting infected with a virus, or your domain name being held hostage.
(More common and recent attacks that are much worse)

You want to find out who they're hosting with... then google up on proper
DMCA takedown notice etiquette and send a short, too the point, properly
formated DMCA takedown notice to their ISP or host.

For example. For awhile a lot of splogs were using google's blogger.com,
wordpress or some used independant ISP, ie. dreamhost, but much less common.
In this case you simply need to send whatever authority... i.e. google,
dreamhost, wordpress... a properly formated DMCA take down notice stating
exactly what's going on.   Keep it short and simple. It is a very straight
forward case of them copying all your content. Easy case.

The hardest part will be trying to find the proper channels.  I suggest
using a conservative carpet bomb technique before you escallate.  I.E. find
the five best contacts at said host company. These might be support,
sales, technical support... or the VP or CEO.  Depends on the size of the
company.  Give it a few days and if the spog isn't shut down, dig a little
more on who the host is and enlarge your carpet bomb.

Remember. Even though this is an egregious example of someone stealing your
content a few days or a few weeks will not hurt you.  It's not like your own
blog or site is completely down. Likely this won't even affect your
relationship with present and future visitors in the short term.

So put you threats on check and instead go with an important, immediate
response required, you may be held liable if no action is take... approach.
 As opposed to a now, asap, i will sue you approach.

These are slimeballs yes... but they're lame slimeballs at that. This splog
approach is pretty lame and probably not very profitable or effective since
it takes months and months to build SEO / pagerank to get traffic during
which time they can be quickly and easily shut down and their assets /
account / profits seized.

Dave's example is really extreme form of a splog. Its actually nicely
designed as well. Looks real and not just a scrape trying to pull
links.

When this group first started when online video was very new, there
were a lot of sites popping up scraping and aggregating video. Often
they'd just grab RSS feeds and suddenly have instant content.

We came up with a list of best practices that helped set the tone for
what was acceptable:

Dave, keep us up to date with what happens. As others have suggested,
take a deep breath and take it step by step. If this guy gets some
formal letters from an attorney...you may be surprised how quickly it

It looks like it's even worse than imagined. It's not just a copy but
the site is doing a live real-time mirror of my site and automatically
replacing all references to eevblog with war video blog, even in
the forum posts!:

BTW, I found out about by a clued up online advertiser who smelled a
rat. Apparently the guy tried to sign up the site with this online
advertising company, and it just didn't sound right when they
reviewed it before accepting his application. So they did a basic
search and saw it was a copy and contacted me to find out what was
happening.

I think another lesson to learn here is also that you can get anyone to get
your site taken down just by the accusation of impropriety.  If you think
about the other side of that coin, you can see someone abuse that power as
well. I am not suggesting that you are in any way rushing to judgment on
this but i think that is why most people ask that the site be taken down by
asking the owner and then resorting to a DMCA.  Not that the nuclear option
is not effective and obviously fast!

I did email the owner first, giving them the benefit of the doubt that
they may have just copied my site as a temporary template or
something.
But once I realised it was clear deception and they were real-time
leeching and modifying my site for profit, that was it, take-down
notice it was.
I also wanted to stop them from simply pointing their script at
someone else's video blog instead of mine, and the only way to do that
is to have their account suspended.

I don't think it's that easy to get another site taken down just by
accusation. You do have to prove to some human at least at the web
host that they have copied your content. They (I'm hoping) wouldn't
just shut down your site based on an accusation without at least a
cursary comparison between the sites/content in question to make sure
the claim has at least some basis.

BTW, this is the actual host in question:
http://www.pronethosting.net/company/legal/terms-of-service/#cv
They sound quite through and not the trigger happy type.
But I suspect most hosts would err on the side of caution and suspend
the site if there is at least some reasonable evidence of violation.
If there is no evidence however, I'm sure they'd just ignore the
request, or in the case of this host, refer them to the authorities.

Great job David, and again I didn't want suggest anything derogatory.  I
remember Google giving some numbers last year at about this time that
indicated that competitors would send DMCA notices to hosts to take out
competitors and it just reminded me of that study. Again, I actually did a
splog hunter post myself and have been scraped a number of times.  I just
didn't want to instruct others on how to abuse a little power.
