I get around that for local business grade DSL by pointing out that I don't 
sell DSL to anyone.

I buy bandwidth (at a premium) and I can do what I want with it.

When they told me that the school could buy the service and put 40 pc's on 
it there wasn't much more that they could say when I wanted to put 20ish 
pc's on it :-).

I swear I was told this service was not to be used to be resold.  I
 might be wrong...but I saw a contract similar to that here in KY and it

The minute you put anyone else on that service you break them.

fee or otherwise) the Service, or any portion thereof, or make any use of the 
Service other than for Customer’s internal business purposes, unless otherwise 
agreed in writing by TWC. 


If you have this in writing share a copy - as I am sure everyone under the sun 
in Ohio, Kentucky and other states would love to be able to get the same deal.

I actually sent the same paragraph to our sales person at TW back when I
started using them and pointed that out.  That's when I insisted that he
contact his big shots about it.  The answer that came back was that my
Internal Business is indeed the reselling of bandwidth thus it was
allowed.  So I guess the In Writing is pretty much what they sent back to
us.

Again, the only stipulation to the Home Based Business rate was that it not
be installed at a commercial address.  I'm on my second TW salesperson now
and the new person knows what we do as well.

Okay, found my TW crap.  

Here's part of what I sent to our salesperson.

.I was going over one of the service contracts that I have with Time
Warner for one of the hotels I do data services for and I see where it
states in paragraph 4, listed as Customer Obligations.

Customer agrees not to resell or make any use of the Service other than for
Customer's internal business purposes.

We will be using this bandwidth for our local wireless internet service
(Wisp) to add to our current services.  I know that you and I talked about
that but I didn't pull out one of the service contracts to read it until
now.  Let me know if this is all still okay and also the timeline on the
install.

My answer was..

Robert your concern about resale of bandwidth is not a problem. I checked
and Time Warner only requires that whoever is considering selling bandwidth
just needs to become a commercial account which you are.


Again, hotels and hotspots resell bandwidth.  You just have to get something
in writing from Time Warner saying that it's cool.

for the datacenter - not the wisp stuff I would love to have a backup link that 
only cost $89

is their Home Based Business internet service.  The stipulation is that
it's installed in or at a home, not a retail or commercial address.  It's
administered by the Business Class office, not the regular road Runner folks
but the Business Class people have to be educated on it and made to go look
for it if you ask about it.  The bonus is, it's a 15 down, 2 up service and
it goes for 89 bucks.  I have 2 of them installed as a fall back and since

Problem I had with Comcast/timewarner was with much of a load on the  
system it would lock up. Even as a backup connection it was not  
reliable where I am. And when I mean load, it wasn't much... At the  
highest 30 police cars limited to less than a Meg and some businesses  
also pulling from that location.

Meg both ways for less than I was paying for my 2 Bonded T-1's. I've got a 
full Class C of IP's, and can get more if I need them.

Not sure about other states but here in Ohio I was told that there is a law
on the books that says no business can stop you from re-selling their
business type service's. Talked to several Time Warner reps that confirmed
this and I know of 3 WISPS in the area here that were re-selling the
business class cable that they told Time Warner they were going to do with
it and they said no problem.

I had the sales rep specifically go to his higher up whatever
extraterrestrial alien types to ask if it could be resold.  The answer was
yes, as long as reselling bandwidth was the business.  SCORE!  The contract
does not mention reselling at all, only that it is being used as a home
based business.  At least here in Ohio it is worded that way.  I have
another being installed as soon as our new sales person decides he wants to
do something.

Here Time Warner installed a new fiber network for their cable use and are
using the old fiber as the business class so I haven't had any issues with
those gateways.

Problem I had with Comcast/timewarner was with much of a load on the  
system it would lock up. Even as a backup connection it was not  
reliable where I am. And when I mean load, it wasn't much... At the  
highest 30 police cars limited to less than a Meg and some businesses  
also pulling from that location.

Not where I am here in Ohio.  Maybe the residential but not the business
class.  How else would a hotel resell the internet or a hotspot provider?
I've had Time Warner put in writing that they understand that I am an ISP
and I resell bandwidth.  They are all for it.

Not sure about other states but here in Ohio I was told that there is a law
on the books that says no business can stop you from re-selling their
business type service's. Talked to several Time Warner reps that confirmed
this and I know of 3 WISPS in the area here that were re-selling the
business class cable that they told Time Warner they were going to do with
it and they said no problem.
