I agree. but who is willing to hear our complaints/request? Since we are minority, and our society is not going to decide their political victory, mostly none of the stupid politicians are gona take care of our request, in my opinion. Hello , In view of the recent harassment cases by the airlines with the disabled people, I would suggest that it is high time that we demand Constitutional amendment for protection under Article 15. Such instances must be declared an offence and must be penalized .We must strive for a statutory protection somewhat on the same lines as provided to SC/ST. Such acts are violation of the civil rights and civic liberty of the disable people and should be considered an infringement of the right to live with dignity under Article 21 of the Constitution, If the right to travel abroad can come within the purview of the right to life than such acts also amount to violation of the Human Rights of the disabled people. There must be protection officers with power to take action on complaint and the power to take action suo moto .Not to say that such legal provisions would cure the problem but it will certainly create awareness and may also act as deterrent .This will make such instances an issue of Human Right violation and sensitize the people. Can not we organise mass demonstration, road jam, and agitation in front of Parliament, Prime Minister, President, ministry's office and to different stake holders? Or, cannot we launch the Airport Gherao for even for few hours? Cannot these attempts be followed in different states with ample media coverage? For how long we will keep on petitioning and begging for our human rights? I think the time demands us now to come out of our houses, offices and cocoon of intellectualism. Discussing such disgraceful incidents in our drawing rooms and in limited forums is not going to serve the purpose sometimes. It requires action, and action as an eye opener for rest of the world. Re: [AI] Harassment of the disabled people by the air lines .
Hi to all, Purnima, I don't think the protection of article 21 is not available to the disable community. The amendment to the constitution is necessary but it doesn't mean that we can do nothing without it. one year back Sambhavna, (a Delhi based NGO) started collecting online signature for constitutional amendment. The amendments that they proposed were excellent, thanks to the valuable guidance available to them from Dr. Upendra bakshi. But we've got no updates after signing the petition. I am saying it, because, our respected members of that NGO sent the URL here to the list. Since you’re a law gradas far as I know, , Don’t you think that provisions of IPC are sufficient to prosecute to these airline personnels? It has been almost 15 days to jeeja ghosh incident, on 21st of feb Ms. Anjali was discriminated, again she met with similar kind of treatment on 29th of feb. But I don’t know that why they have not gone to the concern high court, or directly to the supreme court? No legal development is known, except that the CCPD has taken the matter suo moto!!! I strongly feel and believe that Instead of going here and there or complaining to the airliner or govt, they should have directly gone to the supreme court! [AI] Rights of differently-abled air passengers to be discussed
Rights of differently-abled air passengers to be discussed NEW DELHI, March 4, 2012 Concerned over recent incidents of violation of the rights of differently-abled passengers by some airlines, the Civil Aviation Minister has decided to convene a meeting to discuss the issue with voluntary organisations working for their rights. In a letter to convener of the Disabled Rights Group (DRG) Javed Abidi, Civil Aviation Secretary Nasim Zaidi said the Ministry was concerned about non-adherence to the regulatory framework. All steps assured He informed Mr. Abidi that Joint Secretary G. Asok Kumar had been directed to convene a meeting to discuss the issues raised by DRG. “I assure you that the Ministry will take all possible steps to not only ensure compliance with the regulatory framework but, if need be, also to strengthen it further.” Recent incidents The Ministry's decision comes in the wake of reports of recent incidents — a disabled passenger was ordered to be disembarked from the aircraft by the captain of a private airline, and another was not provided a standard wheelchair. http://www.thehindu.com/news/national/article2958103.ece -- G. [AI] Strange problem after scanning with avira Antivirus
Hello friends: I am using windows XP service pack 3. I scanned my system with Avira Antivirus and I clicked on delete all virus button. After Rebooting my computer I found all useful software including jaws had been crashed. I tried to reinstall them, but failed to do so. NVDA is only screenreader that is survived. Freeware softwares are running well, but MS Office, IE and many others left me alone. I tried to restore my computer but could not do so. Please send me suggestion soon. I don't want to format my system. Some friends told me that formatting is the only solution! is it true! I hope that my friends will help me. Thanking in advance. Regards, Arpit jain.. The film, directed by Pramod Joshi, marks Anupam Kher's debut in Marathi cinema. When you play the role of a differently abled person then you discover how brilliantly they live their lives. This is a tribute to all the blind or visually impaired people...hope everyone would like it, he told reporters at the music launch of the film here . It was Anupam Kher who at the last minute suggested that his character in the film should be blind. [AI] Harassment to the disabled people by the airlines
Hello friends , In view of the responses of the members on the issue I would like to say that Constitutional protection to the disabled is inevitable .The Constitution is the basic law of the land ,I am surprised that the founding fathers of the nation made every effort to make the best and the most detailed Constitution in the world ;it gave protection to SC/St ,Women,OBcs but forgot to mention disability as a ground while drafting important Articles like Article 15,16 etc. .True the protection of Article 21 is available to the disabled people but in very few cases the court has invoked this Article in matters affecting the disable community .coming to this particular issue of harassment I strongly feel that there is little sensitization among the people regarding ill treatment given to the disabled people .Sorry if it offends anyone but most of you would agree that people in general do not consider the ill treatment given to any disabled person as something against law ,something illegal or as an act invoking criminality .Even the disabled person in general accepts the behavior and does not complaint .It is well known fact that people would treat you as you would allow them to treat you.Akilesh I really do not remember what provisions in IPC you are mentioning ,even than I strongly advocate constitutional protection and a separate law too like the protection of civil right in case of SC and ST .Legal experts would recognize the need and the urgency of such a Constitutional protection .Dinesh you are right to point out that we are a minority and politicians do not take us seriously but somewhere we as community has failed to make our voices felt .There is a strong need for a pressure group to lobby for the issues affecting the disabled .We should work for political empowerment of the disable community if we want any significant change in our state of affairs .There is also a need for political representation of the disabled people ,we should demand reservation in the Parliament and the state legislatures .One member has suggested some modalities for organizing the disabled people on the matter of demanding Constitutional protection they are good and worth considering .However we need continued and planned strategies for the struggle Thanks..
