you can listen to commentary  of west indies cricket from class radion from 
jamaica by googling it.  Usually, I don't listen to radio through various 
apps, I directly paste the links to the browsers.  Using various apps 
consumes lots of space/data.

thanks p subharmani, could you also please suggest which chennel gives
cricket commentry on radio in west indies also provide the link. one
more thing, which app is better to install to listen these radio
stations currently I am using simple radio app to listen these

Dear Devashish,

Thanks for writing in. And I am glad that you have taken the first step by 
being aware.

While there are well qualified bankers here, so lets wait for detailed answer 
from them.

From what I know, executives typically either sit at cash counter as bank 
teller or they handle customer service executive's responsibilities, which to 
my mind involves every normal role except dealing with cash.

I have known many people doing the latter but in your case, you can consider 
either of this along with a magnifier if your eyes do not get impacted in a 
long run. With workarounds in place, I believe you should be able to discharge 
all responsibilities as CSE. E.G. Barcodes on passbooks if IDBI has adopted the 
same.

You may want to join a google group of visually impaired bankers, and visually 
impaired bankers employees welfare association. Simple googling will point you 
to these resources.

Challenge II: structural challenges
Mr Jain: how to make all people with disabilities aware about the
provisions under the RPWD Act. If we are able to achieve this,
majority of our challenges will go away.
Mr Jain: 2.68 crores people with disabilities are not sitting only in
Delhi and Mumbai, they  are their in the villages and making them
aware about their rights should be the key.
Mr Jain: if we are to bring accessibility, we will have to train,
municipal workers, and the other stakeholders such as SP, DSP and the
Majistrates.
Mr Jain: removal of prejudice against PWDS. Publick employers should
be made aware of the skills of PWDS.
Mr Jain: procedural challenge: all state CCPD offices should become
the centre for the monitoring and coordinating of the schemes.

Speaker: KK Pandey (CCPD)
Mr Pandey: though the numbers comprising of state commissioners, NGO
representatives government officials and the researchers are less but
we should not forget you are the seed which will germinate and bring
out the necessary change required in the country.
Mr Pandey: In Maharashtra, Gulab Ray Maharaj was the one blind
‘divyang’ who wrote 150 books thousand years ago.
Mr Pandey: ‘Divyang’s have always contributed for the nation. They are
not burdens what they need an opportunity. Of late science has won
over disability. Anyone can become ‘divyang’ so we all should be aware
about its challenges.
Mr Pandey: In the last 2 and a half years, the government of India has
organized more than 4 thousand equipment distribution camps and moore
than 6 lakhs ‘divyang’ have got benefited. The government had to incur
around Rs 4 crore for this initiative.
Mr Pandey: We are now moving from the charity approach to the rights approach.
Mr Pandey: the government wants to implement the RPWD Act on the
Ambedkar Jayanti on 14th April 2017. Remember the PWDA 1995 took 3
years to see its rules notified. You can thus see the commitment of
the Modi Government.
Mr Pandey: There is no fixed format in the disability sector. Its
evolving and we have to remain vigilance. Its not a sector where trade
union operates. We have to find solution with consensus in the sector.
Mr Pandey: There is need to give opportunity to all ‘divyangjan’ of
the country. I end here Thank you.

Speaker: N S kang Secretary DEPWD
Mr Kang: The government and the civil society need to work in tendom
to see that the law is implemented effectively.
Mr Kang: on the 10th of March we put the draft of the rules on our
website, please send suggestions. Send us your objections soon so that
we could publish the rules on 14th on April on the occasion of
Ambedkar Jayanti.
Mr Kang: the larger challenge is to how we make disabled people aware
about their entitlements envisaged under the legislation.
Mr Kang: in the last 2 years, we have sceen great change in the
attitude of peoplw towards PWDs which is encouraging. We should carry
on the momentum. We are determined to ensure equal status for the
people with disabilities.
Avinash: We break for tea now. We are heading towards the lift which
is Braille-embedded. The people have now started networking. Some NGO
representatives are looking desperate to meet government officials.
They have to show their credentials. My friend Yogesh and Me both
totally blind have found a table and one of the CCPD Office officials
has instructed her colleagues to take care of our tea and snacks
requirements. On my table, I happen to meet one woman who has a son
who has multiple disabilities. She sstrikes a conversation: ‘Hi’, I
responded Hellow! We discussed inclusive schooling and debated the
prose and cons. Then we are meeting the State CCPD of Nagaland, who
informes us that as per 2011 Census, in Nagaland there are only 29
thousand six hundred children have disabilities. He lamented that his
office is clubbed with the social welfare department, and fund
scarcity is the huge problem. We are done with tea.

  1.. This note examines the question as to  whether the Rights of Persons with 
Disabilities Act, 2016 seeks to create a parallel and distinctive category of 
persons with disabilities in addition to the overarching category of 'Specified 
Disabilities' as defined in Section 2[zc]. The definition of persons with 
disabilities envisaged in Section 2 [s] of the Act is a case in point; and the 
said Section runs as follows: " 'person with disability' means a person with 
long term physical, mental, intellectual or sensory impairment which, in 
interaction with barriers, hinders his full and effective participation in 
society equally with others;". 
 

  2.. The schedule to the Act lists out 21 conditions of disabilities together 
with their respective definitions, and these have been enumerated under five 
broad categories of physical disability, intellectual disability, mental 
behaviour, disability due to', and multiple disabilities. These 21 
conditions/disabilities are called 'specified disabilities'. Section 99 of the 
Act empowers the central Govt. to amend the schedule which means that it can, 
if it deems fit add to the number of conditions/disabilities  or otherwise 
modify the schedule. 
 

The Act further seeks to create a sub-category within the overarching category 
of 'specified disabilities' to be known as 'person with benchmark disability'. 
Section 2 [r] of the Act says that 'person with benchmark disability' means a 
person with not less than forty percent of a specified disability where 
specified disability has not been defined in measureable terms and includes a 
person with disability where specified disability has been defined in 
measurable terms, as certified by the certifying authority. 

 

Under the Act, persons with benchmark disabilities shal also be entitled to 
certain benefits such as those of reservation in Govt. jobs, in poverty 
alleviation schemes, in preferential allotment of land at concessional rates, 
ETC. Thus, these benefits shal not be available under the Act to those persons 
who come under the overarching category of 'specified disabilities'; but who do 
not qualify as persons with benchmark disabilities. However, the Act will 
otherwise apply to such persons as well; or one can say that the Act will apply 
to such persons also except as otherwise provided.  

 

 

  3.. To my mind, the intention of the legislature in inserting the generic 
definition of 'person with disability' vide Section 2 [s] could not have been 
to create a distinctive, separate and parallel category of persons with 
disabilities in addition to the overarching category of specified disabilities 
on account of the following reasons: 
 

1.. Had it been the intention of the legislature to create a distinctive, 
separate and parallel category of persons with disabilities as stated above, it 
would also have provided for certification of persons coming under the said 
distinctive, separate and  parallel category on the lines of Chapter ten of the 
Act which provides for certification of specified disabilities. However, the 
fact remains that there is no provision of certification of persons with 
disabilities which corresponds to the definition of persons with disabilities 
vide Section 2 [s]. 
 

2.. The very fact that Section 99 empowers the central Govt. to amend the 
schedule also goes to show that no such separate or parallel category of 
persons with disabilities was intended. 
 

Based on the above, one may ask as to why then the generic definition of 
persons with disabilities was at all inserted vide Section 2 [s]? It appears 
that the purpose of inserting Section 2 [s] is to highlight the traits commonly 
shared by persons who come under the overarching  category of 'specified 
disabilities'. 

 

 

In the above view of the matter, the Govt. may like to examine the issue and 
consider incorporating the following formulation by an order under Section 98 
on removal of difficulties:

 

"For removal of doubt, it is hereby clarified that the definition of 'person 
with disability' contained in Section 2 [s] shall be construed only as 
highlighting the traits commonly shared by persons who come under the category 
of 'specified disabilities', and not as creating a parallel category of persons 
with disabilities separate from the category of 'specified disabilities'.

[AI] Commentary on the Challenges in the Implementation of the RPD Act By former CCPD MR PK Pincha

Hello friends!

While I am usually not very active on the social media, I somehow chanced 
upon a report posted on the social media including on the facebook concerning a 
seminar on challenges in the implementation of the RPD Act held yesterday at 
the Pravasi bharteeya Kendra and hosted by the office of the CCPD. I appreciate 
the young friend who took pains to do the reporting. 

Since I too  happened to participate there in a panel discussion on challenges 
in the implementation of grievance redresal mechanisms, I thought it would be 
expedient for me to put matters in perspective by sharing a broad gist of what 
I had stated. 

So, here goes the broad gist of some of  the points I flagged up for reflection 
while highlighting issues and challenges in respect of the matter:

1. While the functions of the Chief Commissioner for Persons with Disabilities, 
and the state Commissioner for Persons with Disabilities as the case may be, 
have been both widened and deepend, there is no commensurate and qualitative 
enhancement in the powers of theChief Commissioner and the State Commissioner.

2. There is glaring mismatch between the functions of the Chief Commissioner 
and the State commissioner and the qualification prescribed for these positions 
in the parent Act though this issue appears to be getting addressed to an 
extent in the draft rules.

3. In effect, the RPD Act explicitly states that Chief Commissioner and State 
Commisioner can only recommend. It also says that the concerned authority is 
free not to act on the recommendation of the Chief Commissioner and the 
Commissioner in which case all it has to do is just to manufacture a reason for 
not doing so and inform the Chief Commissioner or the commissioner accordingly. 

4. referring to Section 75 [1] [b], I stated that the Chief Commissioner and 
the State Commissioner should either have the discretion to decide which matter 
it needs to refer to the Advisory Committee; or alternatively, the rules need 
to ensure that the Advisory Committee meets very frequently so that 
cases/complaints are disposed of with reasonable expedition. 

5. I also stated that conflict of interest should be a disqualification for 
appointment as Chief Commissioner and state Commissioner. 

6. Stressing the need for primary stakeholders' participation in the 
institutions of chief commissioner and State Commissioner, I emphasized that 
the rules should explicitly state that other things being equal, preference 
shall be given to candidates with disabilities while considering appointment of 
Chief Commissioner and State Commissioner. The rules should further provide 
that disability of a candidate shall be no disqualification for appointment as 
chief commissioner and state commissioner. 

7. I also pointed out the inherent contradiction between Section 23 [1] and [2] 
and hammered home the need to grapple with this issue including by exploring 
the possibility of clarifying it by issuing an order under Section 98 of the 
Act on removal of difficulty. 

8. I also stated that another order under Section 98 will be required to 
address some confusion which is likely to arise as a result of nuanced 
categorization of persons with disabilities. In that context, I added that I 
had developed a brief note on this specific issue and shared it with the Govt. 
I would be willing to share the note with whosoever wants it. 

Needless to state here that the rules are intended only to operationalise the 
provisions of the parent Act; and, one can not step out of the ambit of the 
parent Act.

Mr Jain: 2.68 crores people with disabilities are not sitting only in Delhi and 
Mumbai, they  are their in the villages and making them aware about their 
rights should be the key.
Mr Jain: if we are to bring accessibility, we will have to train, municipal 
workers, and the other stakeholders such as SP, DSP and the Majistrates.
Mr Jain: removal of prejudice against PWDS. Publick employers should be made 
aware of the skills of PWDS.
Mr Jain: procedural challenge: all state CCPD offices should become the centre 
for the monitoring and coordinating of the schemes.

Mr Pandey: though the numbers comprising of state commissioners, NGO 
representatives government officials and the researchers are less but we should 
not forget you are the seed which will germinate and bring out the necessary 
change required in the country.
Mr Pandey: In Maharashtra, Gulab Ray Maharaj was the one blind ‘divyang’ who 
wrote 150 books thousand years ago.
Mr Pandey: ‘Divyang’s have always contributed for the nation. They are not 
burdens what they need an opportunity. Of late science has won over disability. 
Anyone can become ‘divyang’ so we all should be aware about its challenges.
Mr Pandey: In the last 2 and a half years, the government of India has 
organized more than 4 thousand equipment distribution camps and moore than 6 
lakhs ‘divyang’ have got benefited. The government had to incur around Rs 4 
crore for this initiative.
Mr Pandey: We are now moving from the charity approach to the rights approach.
Mr Pandey: the government wants to implement the RPWD Act on the Ambedkar 
Jayanti on 14th April 2017. Remember the PWDA 1995 took 3 years to see its 
rules notified. You can thus see the commitment of the Modi Government.
Mr Pandey: There is no fixed format in the disability sector. Its evolving and 
we have to remain vigilance. Its not a sector where trade union operates. We 
have to find solution with consensus in the sector.
Mr Pandey: There is need to give opportunity to all ‘divyangjan’ of the

Mr Kang: The government and the civil society need to work in tendom to see 
that the law is implemented effectively.
Mr Kang: on the 10th of March we put the draft of the rules on our website, 
please send suggestions. Send us your objections soon so that we could publish 
the rules on 14th on April on the occasion of Ambedkar Jayanti.
Mr Kang: the larger challenge is to how we make disabled people aware about 
their entitlements envisaged under the legislation.
Mr Kang: in the last 2 years, we have sceen great change in the attitude of 
peoplw towards PWDs which is encouraging. We should carry on the momentum. We 
are determined to ensure equal status for the people with disabilities.
Avinash: We break for tea now. We are heading towards the lift which is 
Braille-embedded. The people have now started networking. Some NGO 
representatives are looking desperate to meet government officials.
They have to show their credentials. My friend Yogesh and Me both totally blind 
have found a table and one of the CCPD Office officials has instructed her

I shared this report with the state disability commissioner of
Nagaland to seek his response he said the situation is the same in the
Nagaland. He is a doctor by profession and heading the disability
commission in the state. What is more encouraging from Meghalaya and
Bihar recently is that assembly leaders have taken up the
disability-related discrimination with the respective states
government. We're going in the right direction.

I am surprised to find that the DOPT has not issued the OM to the
Govt. Organisation  till date.  Whereas the Honorable SC has very
vividly given the verdict on 30 Jun.2016 regarding the reservation on
promotion for person with disability.

Have we taken any action on the same?  It shows that even the DOPT is
not serious on the matter.

Friends, don't you think that this is the real  Contempt of Court?

ASSOCHAM is organizing a conference on the given subject on 21st March
2017 in New Delhi at Le-Meridian Hotel. They have asked me to send the
list of students from JNU or anyone in Delhi who is willing to
participate. I'm therefore seeking your support through Accessindia
and Jnuvision group. Please send your names to me personally on

have to prepare a list and send it across to the organisers. I hope
