There's a whole lot of big open quizzes coming up in Goa over the next couple of weeks. All of these are free and open to all. To begin with, Mahaquizzer 2010, the National Quizzing Championship, will be held starting 9.30am at Pharmacy College, Panjim, on Sunday May 30. It's a solo written quiz, to be held simultaneously in 14 centres around India. The highest scorer nationwide is officially acknowledged as India's quizzing champion for the year. Registration for this event closes on Sunday, May 23, so anyone interested better move fast. To register, send an e-mail message to mahaquiz...@gmail.com, mentioning your full name and the centre from which you will be taking the quiz (Panjim, for anyone planning to take the quiz in Goa). If you are a student, mention your age and institution (school or college). Later the same day, at 3pm, Harsh Bhatkuly will conduct the 2nd Chandrakant Keni Memorial Goa Quiz at the Hotel Mandovi in Panjim. This one's for teams of two, and the scope of the questions is limited to Goa specifically. And a week later, the World Quizzing Championships will be organised on June 5. WINNIE COUTINHO’S SILENCE, A SIGN OF GUILT Parts of your editorial “ Campaigning, in style ” in your daily, the Herald dated 17th May are factually incorrect. At the very outset your comment that a section of the media have been gunning for Mrs. Winnie Coutinho is very unfair to your colleagues in the fourth estate. Your newspaper and another local English daily (having an aversion to my name) are the only ones that did not cover the Winnie Coutinho Saga. So was the entire media wrong and your daily the only one that did (in) justice by not reporting the issue. While you have been quick to condemn the ‘media trial’, you apparently forgot the role played by the media in serving justice in the Jessica Lal murder case. In this case as in the others justice would have been perverted by the powers that be, were it not for the public pressure exerted through the media. True, there is a need for systemic checks and balances (that work), the absence of which cannot be an argument for allowing corruption to go unchecked. It is obvious in Mrs. Winnie Coutinho’s case that the checks did exist, but the powerful political arm checkmated it. We brag about freedom of the press but the ‘business partner’ of Mrs. Winnie Coutinho was able to block the news in your daily by his close and powerful links with your paper. This priest who prefers to go by the title Mr. as you may know is a holder of a journalist identity card issued by your newspaper. Every other newspaper including the national and electronic media highlighted the issue as it was obviously a serious matter that the government after coming to a finding that Mrs. Winnie Coutinho was corrupt and incompetent allowed her to continue as Public Prosecutor in the High Court due to the political pressures exerted by two South Goa powerful politicians Mr. Mauvin Godinho and Mr. Churchill Alemao. Mrs. Winnie Coutinho had a right to defend herself. She could have placed her side of the story and fought back. But she chose to stay quiet and slip off into the wilderness by resigning. This is a clear admission of guilt. She knew very well that she had no case to defend Union Minister for Law and Justice Dr. Veerappa Moily’s recently said that persons with doubtful integrity should not be made judges. Mrs. Winnie Coutinho’s name could in no way be considered for appointment as Judge of the High Court and for that matter for any judicial position. I have nothing personal against Mrs. Winnie Coutinho but one has to have the courage and conviction to speak up in public interest even at the risk of getting one’s fingers chopped. Every allegation I have made against Mrs. Winnie Coutinho was based on documented evidence which I have obtained from the Government itself under the Right to Information Act. Your reporter who covers the High Court proceedings would be in a better position to enlighten you more on the misdeeds of Mrs. Winnie Coutinho. You have also referred to the helmet issue. It has been and continues to be my stand that helmets alone will not save lives. We need to make our roads safer and usher proper traffic management to control the number of accidents. By the way I do use the helmet now. You have also referred to the Ribandar Church case where I focusssed on an individual priest. Yes, I did so and had to nail the priest who had molested an innocent 13 year old girl on Christmas eve in the Church premises. In the cocktail of issues referred by you, is my relationship with Mr. Manohar Parrikar. Yes, we may have deferred on various issues but one cannot deny the good Mr. Manohar Parrikar has done to Goa and Panaji in particular. I do not believe in petty politics and have friends and good relations with persons in all political parties You have also referred to the case of the politician’s son. This case was handled by me as an Advocate and not as a campaigner. Every lawyer is within his rights to take up or withdraw from any case. And in that particular case I acted within my rights. You were unfair in stating that in my past campaigns I have been targeting individuals rather than issues. I am happy that as I turn 50 next week I have taken up an equal number of issues over the years. While highlighting an issue it’s bound to hurt some individuals. The recent case at hand is the clean up of the IPL where Shashi Tharoor and Lalit Modi have had to bear the brunt. You need to weed out the rotten individuals to get to the bottom of any issue. Photo: R.Eswarraj At least 154 passengers are feared dead when an Air India Express Boeing 737-800 flight from Dubai overshot a runway at the Mangalore airport, and burst into flames as it crashed into a wooded valley on Saturday at 6.10. a.m. The cause of the accident has not yet been established. An Air Traffic Control official told The Hindu ruled out poor visibility as a cause. Visibility was six km. The bodies of those who died in the crash are being taken to Government Wenlock Hospital, Hampankatta, Mangalore. There are at least eight survivors, official sources told The Hindu. The survivors include: Joel Prathap D’Souza (KMC hospital, described as a “young man around 25-30 years old”), Mohammad Umer Farooqi, (KMC hospita), Sabrina Haq, a medical intern from at the Kasturba Medical College, Mangalore (KMC hospital). Three other survivors, Mayan Kutty, from Kasargod, Pradeep G.K., from Tannirbhavi, Mangalore, and Krishnan Kollikunnu, have been admitted to the SCS Hospital, Mangalore, Abdulla Puttur Ismail is admitted to K.S. Hegde Hospital, Derlakatte, Mangalore Taluk and Mohammad Usman at Unity Hospital. Bank employee, child feared dead Narayan Rao (48), an employee of the Karnataka Bank, Bejai branch, a child Hiba Zeena were identified as among the dead. All flights to and from Mangalore have been cancelled until further notice. The captain of the flight, F. Glusica, from Serbia, and his co-pilot H.S. Ahluwalia, are feared dead. Mr. D'Souza came to the airport from the crash site in a vehicle and said he was a survivor of the crash. He was immediately moved to the hospital According to M.R. Vasudeva, Airport Manager, Bajpe, there were six crew members on board. Village residents have rescued six passengers. The airport has a table top runway. Govind Belgaumkar reports from Mangalore airport: Anxious and frightened relatives and friends of the Air India Express flight passengers from Dubai that overshot the runway and burst into flames, throng the Mangalore airport for news of their loved ones. The airport authorities have pasted the passenger list on pillars in the airport. The exact number of causalties is still not known, but the injured have been removed to four hospitals. These are S.C.S Hospital, Balmatta, Mangalore; KMC Hospital, Jyothi Cirlce, mangalore; Government Wenlock Hospital; and A.J. Hopsital. Amongst those who have been waiting from 7 a.m. at the airport are Annette D'Mello and Preena Castellino whose relatives were on the flight. In tears, they told The Hindu that the names of Venisha Nicola Lobo (15), Vishal Floyd Lobo (8) and Flavia Shakuntala Lobo (39) were not on the first list of survivors that the airport authorities have issued. I fell a few feet to the ground and saw it was a hilly area. I crawled away from the flames and some village residents took me on a two wheeler to the nearest junction. AISI: Poltodcho Munis http://www.flickr.com/photos/joegoauktiatr4/4621201114/ I finally had a chance to watch this Internationally acclaimed film ‘Poltodcho Munis’ (Man from other side of the bridge) by Laxman Shetgaokar. The story mainly revolves round the lone Forest Guard, Vinayak, the unsound (Pixi Bhail) woman and the rope suspension (wobbling) bridge. Vinayak who lost his wife at a very young age was attacked by a wild animal in the same forest where he worked for than 15 years. This young mentally unsound woman whom the villagers treat as a curse of the socitey, often seen chased by young village kids. As for the bridge, I would say the film starts with the ‘bridge’ and ends with ‘no bridge’ Depicting of typical Goan village life in a remote area and the sounds of birds, the animals and the insects/bees in the forest makes the film really natural and lively. I must say, I would have not enjoyed the film if I had watched it on a DVD or VCD at my home TV The wide screen with stereo surround sounds etc make the film really vivacious The panoramic film with something to learn from is simply not to be missed. The movie is now showing at El Monte Vasco and Maquinez Palace, Panjim Sidelights: - Sadly, there were not that many Konkani Film watchers on the first day. I would say less than 25 including some volunteers/crew. - Ticket Rs.100 per head - No much publicity, little insert ad in the Herald was so tiny that one will need reading glasses to see dates and telephone numbers etc - The 'Mauxi' in the film seems bit modern where she once uttered ‘forest’ iso ‘ran’. If his remarks rankle, so be it, as that is the way it was meant to be. Keep it up Soter. As the old saying goes, sticks and stones can break your bones but ill advised words will do you no harm.

He was found moving among the Orissa-based workers working in different factories here. The tip off came from the Orissa police. Goa police nabbed him, along with his accomplice Rajendra. Police also rounded up hundreds of other workers, but later released them. The information we got from the police sources was that Shambhu's Naxalite outfit is working among the Adivasis in Sundergarh district of Orissa. The main issue they had taken up was increasing alcoholism among the tribals. To end it, they had taken an extreme step of killing one such liquor supplier. Orissa's Naxalite movement is not a new phenomenon. In fact it took me back to the famous Marathi play, written by Anil Barve in 1975 - Thank You Mr Glad. Based on a life of then doctor-turned-Naxalite Nagbhushan Patnaik, the play had glorified Veerbhushan Patnaik, the Naxalite in the play. The play had made waves in Marathi and Gujarati theatre. Sundergarh is one of the Naxalite-infected 30 tribal districts of Orissa. It's on a border of both Jharkhand and Chhattisgarh. The plight of tribals, peasants and landless labourers has resulted into left extremists gaining ground in these areas. There are many outfits working in these areas. I tried to search for Maowadi Trishul Manch. The Google search is full with only one news - MTM leader Shambhu Beck arrested in Goa. I went through some research articles on Naxalite movement in Orissa. It lists out many Marxist-Leninist groups (called Naxalite since ‘70s and Maoists nowadays). But no mention of MTM... But our local media speculated a lot. The prime speculation among these was whether Naxalite movement has some roots in Goa. Even our state chief secretary has asked the police to investigate into this angle. The investigation is fine. It is a must. But simply jumping to a conclusion that Naxalism has started taking roots in Goa appears premature. Naxalite movement cannot be equated to the movements of religious fanatics or terrorist outfits, just because all three believe in violence. That does not mean violence by Naxalites is justified and by others is unjustified. Any violence is unjustified, including the war! But Naxalite movement has always grown with middle class leftist intellectuals identifying themselves with the poor, downtrodden, neglected and exploited - may it be peasants, workers, landless labourers, tribals etc. It grows in underdeveloped areas, where the locals are exploited beyond imagination. The struggle between ‘Haves' and ‘Have-Nots' thus takes a violent turn with armies of both the camps battling with each other. It literally becomes an internal battlefield... with killings and blood all over... This is not a sheer imagination of mine. Even Prime Minister Manmohan Singh admits it. Let's read the following quotes of the PM, who made a speech last month on Civil Services Day function in the national capital. QUOTE: Underscoring the fact that Left-wing extremism was flourishing in under-developed areas of the country, Manmohan Singh asked the civil servants to ensure that no area of the country is denied the benefits of the government's developmental programs. But we cannot overlook the fact that many areas in which such extremism flourishes are under-developed and many of the people, mainly poor tribals, who live in these areas have not shared equitably in the fruits of development. It is incumbent upon us to ensure that no area of our country is denied the benefits of our ambitious developmental programs, the Prime Minister said. He asked them to devise innovative ways and means to harness the tools of information technology and to involve the intended beneficiaries in implementation so that complaints of leakages, corruption and lack of transparency get addressed. Manmohan Singh said that inclusive growth was the centrepiece of the developmental agenda of the UPA and fast economic growth provided the government with the resources to address the problems of poverty, ignorance and disease. I was also sent to Kapenguria during the Kenyatta trial and used to see Kenyatta and the political prisoners charged with him -being led daily from the Prison,passed my government quarter to the improvised Court house.Also met several of the Defence Counsel - D.N. Pritt, Diwan Chaman Lal, Kapila and Fitz D'Souza. Being stationed in a predominantly White settler farming area, I was well aware of the Mau Mau activity in the district and within the Province generally. Everyone lived in fear in those days, and seeing white farmers fully armed while shopping, was not an uncommon sight in town. Part of my job(in the absence of the District Commissioner), also included the issue of Travel Passes to members of the Kikuyu, Embu and Meru tribes whose movements were restricted during the Emergency. There is no doubt that atrocities were committed on both sides, but some of methods described by Elkins are truly barbaric and cannot be condoned. During my later posting to the Northern Frontier Province - where many of the political prisoners were restricted, I was also responsible for visiting them, censoring all their in-coming and out-going mail etc. All this at a time when the D.C. was the sole Administrative official, with no District Officer to assist him. It comemmorates the giving of the Law in the Jewish tradition and giving of the Spirit in the Christian tradition. In the book of the Acts of the Apostles we have the story of the first Pentecost: And suddenly there came a sound from heaven, as of a mighty wind coming, and it filled the whole house where they were sitting. And there appeared to them parted tongues as if it were of fire, and it sat upon every one of them: And they were all filled with the Holy Spirit, and they began to speak in other tongues, as the Holy Spirit gave them to speak (see Acts 2:1-13, esp.2-4). As Jesus had already promised to his disciples, they were filled with the power of the Spirit. The Apostles began to preach the Good News, the Gospel, to the people gathered in Jerusalem. About three thousand people were converted and baptized on that day. Pentecost is the birthday of the Church: the Spirit of God came upon the people, who were filled with a new vision and entered the new covenant inaugurated by the Death and Resurrection of Jesus of Nazareth, the Christ. Simon Peter explains the meaning of the event (cf.Acts 2:14-36). Pentecost is the turning-point in the salvation history (Heilsgeschichte), as Luke describes the mission of the Church and its inauguration. It is the era of the Spirit--Pentecost inaugurates the era of the Church with the outpouring of the Holy Spirit. Originally, Pentecost was an agrarian feast of the harvest (cf.Nb 28:16; Ex 23:28). It was called the feast of the first-fruits (hag hashabbuoth) and was celebrated on the fiftieth day, seven weeks after the Passover. It was one of the three pilgrimage feasts (Passover, Feast of the Weeks or Pentecost and Feast of the Tabernacles), but already in the New Testament it became the feast of the law-giving or renewal of the covenant. Even at Qumran, it was the feast of the law and covenant of Essenes. It was called the feast of the oaths (hag hashebbuoth). The feast of the first-fruits became feast of oaths. Also in orthodox Judaism it became the feast of law-giving or covenant. The main elements of the biblical episode are as follows: a)a sound (ekhos, v.2, cf.Ex 19:16); b)tongues as of fire (cf.Ex 19:18; 24:17--tongues or arrows, lightenings, torches of fire). Is it xenolalia (gift of foreign tongues) or glossolalia (they began to speak in other tongues, v.4)? As already mentioned, the feast of Pentecost commemorated the Sinaitic Covenant, fifty days after leaving Egypt. An interesting rabbinical text shows how the Jews understood it: It is said: 'God thunders wondrously with His voice' (Jb 37:5). What does 'God thundered' mean? When God gave Torah on Mt.Sinai, he did for Israel great things with his voice. What happened? God spoke and his Voice resounded throughout the world, Israel heard the Voice coming to them from the South: they ran South to meet it. But from the South it turned North...then it veered West...then East...then it moved towards Heaven, but when they looked up to heaven, it seemed to come from the earth as it is said: 'Out of heaven he let you hear his Voice; and on earth he let you see his great fire and you heard his words out of the midst of the fire' (Dt 4:36). Notice that it is not said 'thunder', but 'thunders'. This is why R.Johannan said that the Voice of God split in 70 voices, in 70 tongues so that the nations might understand (Exodus Rabbah). It was glossalia, a phenomenon of the language for praising God, not for communication. According to a rabbinic tradition at the promulgation of the Law, the Voice of God was heard by all nations. It was divided into 70 languages, corresponding to the 70 peoples of the world. This tradition is recalled by the miracle of the gift of tongues--firelike tongues rested on each of the disciples. This may be related to a Jewish legend, based on Ex 20:18: All the people 'saw' (perceived) the Voice, which came as a flame and was articulated into ordinary speech. This is described by Philo in his book, Decalogue (A most terrifying Voice sounds forth from the midst of the fire, pouring down from heaven, the flame being articulated into ordinary speech for the listeners by which what was being said was made visibly distinct, so that it seems that these themes are seen rather than heard). The association fire/word (or law) is found also in a Jewish legend, according to which fire appeared on the head of famous Rabbis, engaged in the study and interpretation of the Law (eg.Rabbi Johannan said that Voice of God split into 70 tongues/voices, so that the nations might understand. THE ELECTRONIC communications has changed the way the world communicates and also the communication habit. The communication via SMS or electronic email manifests the freedom of speech and expression guaranteed by our constitution to every citizen [Article 19 (1) (a)], however, the freedom is not absolute, it is a qualified right, as constitution also sets significant limitations on that freedom, as the state may by law effect such reasonable restrictions as it deems necessary or expedient in the interest of the security of the state, the sovereignty and integrity of India, friendly relations with foreign states, public order, decency or morality or in relation to contempt of court, defamation or incitement to an offence. Due to the misuse of the modern communication devices and increased incidents of sending hate messages, threatening SMSs, threatening Emails to politicians, VIPs in politically charged environment, the legislature introduced Section 66A Information Technology (Amendment) Act, 2008 notified w.e.f. 27th October, 2009 which reads as follows:- “66A. Punishment for sending offensive messages through communication service, etc.- Any person who sends, by means of a computer resource or a communication device,— (a) any information that is grossly offensive or has menacing character; or (b) any information which he knows to be false, but for the purpose of causing annoyance, inconvenience, danger, obstruction, insult, injury, criminal intimidation, enmity, hatred or ill will, persistently by making use of such computer resource or a communication device, (c) any electronic mail or electronic mail message for the purpose of causing annoyance or inconvenience or to deceive or to mislead the addressee or recipient about the origin of such messages, shall be punishable with imprisonment for a term which may extend to three years and with fine. ‘Explanation.— For the purpose of this section, terms “electronic mail” and “electronic mail message” means a message or information created or transmitted or received on a computer, computer system, computer resource or communication device including attachments in text, images, audio, video and any other electronic record, which may be transmitted with the message.” Thus, the legislative intent was to make act of sending SMS, emails, or posting of any messages via communication device or computer resource which is grossly offensive or of menacing character or any information which the sender knows to be false but posted for the purpose of causing annoyance, inconvenience, danger, obstruction, insult, injury, criminal intimidation, enmity etc. or disguised or anonymous emails or fake emails to cause annoyance. “Grossly offensive or menacing character”: However, when an information or message shall be termed as grossly offensive or having menacing character has not been defined or explained in the Section 66A IT Act which leaves room for controversy. Interestingly, the Section 66A IT Act is deeply influenced and probably originated from Section 127 of the Communication Act 2003, an UK Legislation. The wordings of Section 127 of the Communication Act, 2003 are as follows:- “127 Improper use of public electronic communications network (1) A person is guilty of an offence if he— (a) sends by means of a public electronic communications network a message or other matter that is grossly offensive or of an indecent, obscene or menacing character; or (b) causes any such message or matter to be so sent. (2) A person is guilty of an offence if, for the purpose of causing annoyance, inconvenience or needless anxiety to another, he— (a) sends by means of a public electronic communications network, a message that he knows to be false, (b) causes such a message to be sent; or (c) persistently makes use of a public electronic communications network. (3) A person guilty of an offence under this section shall be liable, on summary conviction, to imprisonment for a term not exceeding six months or to a fine not exceeding level 5 on the standard scale, or to both. (4) Subsections (1) and (2) do not apply to anything done in the course of providing a programme service (within the meaning of the Broadcasting Act 1990 (c. 42)).” Thus, the Communications Act 2003 section 127 covers the sending of grossly offending or menacing messages via public electronic communications network. Section 127(1)(a) relates to a message etc that is grossly offensive or of an indecent, obscene or menacing character and should be used for indecent phone calls and emails. Section 127(2) targets false messages and persistent misuse intended to cause annoyance, inconvenience or needless anxiety. The judgment of DPP v. Collins ([2005] EWHC 1308 (Admin)), an UK High Court decision sheds some light to what is “Menacing Character”, in which it observed that “A menacing message, fairly plainly, is a message which conveys a threat – in other words, which seeks to create a fear in or through the

If the educated utilise the methods of the street-chaps, we will lose the freedoms for which many have sacrificed so much. Men of the cloth exercised this unbridled power in the most horrible Inquisition; Doctors, believing that they were all-knowing, became paternalistic at the cost of violating the basic rights of patients; Rulers became ruthless dictators and did away with those who dared to disagree; and now, we have Lawyers using the power of the Courts to harass specific targets. They even are utilising the willing sections of the media to play 'judge, jury and executioner in a campaign of public innuendo and bitter charges'. It is time for all those who are able, to take up the study of law. If not, those who are able, will deplete the helpless of their savings, property and honour. BACKGROUNDER : 22 May 2010 : ESG-BANGALORE Mangalore Air Crash Tragic Fallout of Criminal Negligence of Planning and Regulatory Authorities An Air India Express Boeing 737-800 aircraft arriving from Dubai with 167 on board 2010 tragically crashed at Mangalore International Airport at 6.30 am today (22 May 2010). It is reported that the plane overshot the runway while landing and fell over a cliff resulting in this disastrous crash. Very few are known to have survived this horrific crash. This was no accident, but the direct result of deliberate failure of officials at the highest level in the Director General of Civil Aviation, Airports Authority of India, Ministry of Civil Aviation and the Government of Karnataka for allowing this 2nd runway to be built in criminal negligence of applicable norms and standards. Such a strong charge is being made as the likelihood of this kind of a crash (the worst case scenario) was predicted. A series of Public Interest Litigations were fought by the undersigned to stop the construction of this 2nd runway in Mangalore airport on grounds that the design simply did not conform to the most basic national and international standards of airport design. The PILs also highlighted that the airport does not conform with the most minimum safeguards for emergency situations -- particularly during landings and takeoffs, and could not have emergency approach roads within a kilometre on all sides of the airport as required. It is truly sad that because of the failure of key decision makers at the highest levels so many innocent lives have been lost. It is quite possible that many lives were lost as emergency rescue teams could not access the crash site due to the difficult terrain (a valley) for over a hour after the incident, even though it was proximal to the site.1 Vimana Nildana Vistharana Virodhi Samithi (Local Communities Alliance Against Airport Expansion), Bajpe and Environment Support Group had repeatedly highlighted the high risk expansion of the Mangalore airport during the late 1990s. The expansion was proposed to enable flight movements of wide bodied aircrafts, such as Airbus A 320. Authorities were repeatedly informed that the proposal did not at all conform with the standards prescribed for runway design as laid down by the Director General of Civil Aviation, National Building Code of India and Ministry of Civil Aviation. Further, considering that the airport was proposed for international flights, a case was also made that the 2nd runway could not conform with International Civil Aviation Authority standards due to terrain limitations. No one in authority cared to listen to our fervent pleas. This even when we demonstrated through a variety of representations that that the site chosen for expansion at Bajpe was surrounded by deep valleys on three sides of the runway and did not provide for emergency landing areas as required. This neglect of our legitimate concerns forced us to move the High Court of Karnataka in a PIL in 1997 (Arthur Pereira and ors. vs. Union of India and ors., WP No. 37681/1997). A key concern raised was that the 2nd runway in Mangalore could not meet the standards required in dealing with an emergency, particularly during landings and takeoffs -- a time when air crashes are most likely to happen. The Airports Authority of India filed an affidavit in Court dismissing all our concerns and stated this, amongst other things: It is submitted that as regards the apprehensions of the petitioner that the length and width of the runway is insufficient for a plane making an emergency landing, the same is without any basis. It is respectfully submitted that all the requirements as per the ICAO recommendation will be met and that there has been no infringement of any of the recommendation and limitation therein. There might even be an (easier) case for civil liability in Tort. This does not include the Justices who made the order (I submit) based on the facts available to them..except for the part where they say WE ARE SURE I believe that the following is the most important part of the judicial order (CAPS are Mine) * Thus it can be seen that the expnsion of Bajpe airport project is at the initial stage and the second respondent has in their objections mentioned above unequivocally stated that all the safety measures etc., stated by the petitioners in their writ petition WILL BE FOLLOWED during the progress of the project and nothing can be said before the lands are handed over to the second respondent. Considering these facts, we are of the view that the petitioners have rushed to this court before commencement of the project itself and the WRIT PETITION IS PREMATURE. It is not therefore, necessary to consider the various grounds taken by the petitioners in the writ petition to allege that the respondents have been proceeding with the project in a casual manner. Atala a politician's son It’s all mess. What I feel that police are not interested in digging further into police-drug peddler nexus because they will have to empty at least one fourth of its department and make them sit on the suspension bench. When for the first time I stumbled upon the video loaded on youtube, in which an unknown foreigner was bragging about his links with the police, it was difficult for me to digest what I saw. In movies we have always seen how corrupt officers attached to anti-narcotic cell were clandestinely pushing drugs in the open market. But we always assumed that it's a movie plot. Here in Goa, in the past, instances of police planting drugs on foreigners to extort money have been reported. Few police officers were also suspended and subsequently reinstated for this crime. But here, it was a case of police allegedly selling drugs confiscated in the raids. This was something highly unexpected. Moreover, the drug peddler (later identified as Atala) was naming Ashish Shirodkar, a police officer. I had informal chat with Ashish few months back when he was heading anti-narcotic cell. Standing in the gallery outside deputy inspector general's office, Ashish had almost convinced me to believe that ANC could not do a great job because of shortage of resources. He narrated how the vehicle given by narcotics control bureau to ANC is put in service of a senior officer forcing anti-narcotic guys to patrol beach belts on two wheelers. Atala was a new finding for the journalistic world. When Atala's story was broken, Dudu alias David Griham was the talk of town. ANC was busy selectively leaking the information to its favourite scribes on the his interrogation. The newspaper columns were filled with tales of Dudu, who had attained a mafia tag by then. Director General of Police Bhimsen Bassi was settling after a felicitation function for ANC for nabbing Dudu, when this story surfaced. It was unexpected for police, who were bragging of nailing drug mafia and to a great extent curbing drug trade in the coastal belt. What happened to Atala next is a history and the issue is covered by every newspaper in detail. On Atala's issue, Crime Branch was forced to investigate. Their investigation speaks for their unwillingness to probe police-drug peddler links. Even before the dust could settle on Atala's case, another bolt came from blue. Atala's girlfriend from Sweden, Lucky Farmhouse, gave her interview to PTI and Goa media including Gomantak Times. What she told in the interview was confirmation of what has been alleged in the past by Fiona Mackeown, mother of scarlet Eden Keeling. Lucky said that son of a politician was visiting Atala's place often. Ironically, Crime Branch was reportedly unlucky in locating Lucky for over a month. Lucky said `she was ready for police interrogation but no one contacted her'. She just read on internet that police were seeking help from Interpol to reach her. If we in the media with the little resources available can get Lucky in Sweden over email, can't police do it? It's almost a week after she gave the interview and still nothing seems to be moving on ground, except for few phone calls from the crime branch asking for Lucky's details. It's all mess. There is complete lack of political will to punish the culprits. Whatever is being done is through media pressure. But how long will media continue pressurizing? There is one more irony in the police department. It may be coincidence or deliberate. Raids on drug traffickers or peddlers are being conducted just after Home Minister Ravi Naik and DGP Bassi claimed that there are no drugs in the state. In the first instance, little after Sunburn party mess up, Naik held a press conference to claim that Goa had no drugs. Just a day after that, there were series of raids by district police led by Bosco George and ANC led by Veenu Bansal. This is not an isolated instance. Last week, Bassi said that `drugs do not exist in Goa' and same night Calangute police raided a Nigerian and confiscated huge quantity of drugs. This is entire confusion. Mess... I still remember five years back, when in Sunaparant, we exposed a rave party through sting operation, majority of officers from Anti narcotic cell were transferred. Manohar Parrikar was then a chief minister and allegations were levelled against his cabinet colleagues that they were sheltering this trade in the coastal belt. BJP legislator's inclination towards helping the drug peddlers was visible even during last Assembly session when Siolim legislator Dayanand Mandrekar asked state government's intervention to release a youth caught in a drug case and lodged in Mumbai jail. The idiom is wrongly applied to the media because the media does not take decisions till the end of the case or an issue. The media engages in a trial by media which is not the same trial in a law court. What is public innuendo. Those who were after Winnie may or may have not engaged in inneundo. It is often the person who is the victim of public lashing and media scrutiny cries that the allegations and charges are nothing but inneundos. The sinister motives are now out in open after a long silence on Rahejas Mega project at Carmona. It is anybody's guess where 40 Alibaba's stay when they go to Mumbai. So it all hand in glove deal. Goa do need a state policy but on different issues. Goa needs better health care, education and efficient administration. Goa certainly need investment in affordable engineering medical colleges. Goa need full functional health centers in every village besides multi specialty affordable hospitals where common man take medical treatment. Goa need interrupted water supply in every town and village. 24x7 365 days power supply to light every household in Goa. We need sewage treatment plants to carter our ever populating towns. We need waste treatment plants for every village and town. Lastly, every Goan needs affordable house but certainly not housing complexes, condominiums, high-rise apartments because 99 % of Goan cannot afford it. The commission has said that it's in favour of enacting a new law on the ownership of apartments and flats (regulation of the promotion of construction, sale, management and transfer). The issue attracted the attention of the law commission after it noted that large-scale real estate activities, including the construction of housing complexes, condominiums, high-rise apartments, group houses, rent back tenements, etc are taking place in Goa. The commission noted, It has come to the notice of the law commission that flats, apartments and bungalows are sold along with an undivided share in the properties upon which they are built. A few unscrupulous developers do not take steps to organize cooperative housing societies, companies or associations of owners of flats, apartments, bungalows built on these areas. This leads to a number of problems regarding the management of common areas and common amenities like water, power supply, sewage, garbage disposal, parks, gardens and parking lots. Major metro cities like Delhi and Mumbai have specific statutory provisions controlling and regulating the promotion of construction, sale, management and transfer of flats and apartments having multiple dwelling units. The commission has also noted that the government of India has circulated a comprehensive model act called the Real Estate Management Bill which addresses real estate issues. The bill is expected to ensure greater accountability by real estate developers and builders who sometimes take buyers for a ride. Right from the General in a Deccani army in the 17th century, to Manuel Antonio de Souza (1835-1904), of Mapusa, who created and reigned over his own country with an army of 30,000 men, by the right bank of the Zambezi, in far away Mozambique! Down to dozens of officers in the armed forces of Portugal, Britain and any nation of domicile, even . hold your breath . now Australia-settled Wg Cdr Zuzarte of the Pakistan Air Force! The number of Goans in independent India's defence services is a matter of pride. The tiny community produced one Chief and two Vice Chiefs of Army Staff, one Vice Chief of Naval Staff and one Chief of Air Staff. And at least 42 Generals (from three- to one-star), one VAdm, one RAdm and four Commodores, three Air Marshals, two Vice Marshals and five Air Commodores - and a legion of other officer ranks in the three services. The Chief of Army Staff, as all know, is Gen Sunith F Rodrigues of Curtorim. The Vice Chiefs are Lt Gen Kevin L D'Souza of Mapusa and Lt Gen Stanley L Menezes of Sangolda. The Vice Chief of Naval Staff is Vice Adm John C DeSilva of Navelim. The Chief of Air Staff is Air Chief Marshal Hrishikesh Shamrao Moolgavkar of Mulgao- Bicholim. A bit on him: One of the earliest IAF Goans (slightly junior to AVM Erlic Pinto), he was among the first four Indian IAF officers to earn a MVrC for bravery in JK ops (and one of only three IAF Goans to be so decorated, the others being Gp Capt Sidney Noronha and Gr Capt Allan D'Costa.) A versatile fighter pilot, he flew 56 types of aircraft including helicopters, from pre WW-II vintage to planes without propellers (jets) like Gnats and MiGs. He was the first Indian to fly faster than sound (in a Mystere-II.) Awarded the US Congress' Legion of Merit at the Pentagon in 1978. Goa missed counting three more Chiefs of Staff, one each of the Army, Navy and Air Force. Maj Gen Eustace W Fernandes stood, as AVM Erlic W Pinto did in the IAF, a chance for the top job. He died in 1994, like AVM Pinto in 1963, together with several senior army officers. He was inspecting weapons and explosives seized from JK terrorists when the dump exploded. Both AVM Pinto and Maj Gen Fernandes died in JK - and both, rather uncannily, shared the same initials, EW! (Maj Gen Fernandes' younger brother, Air Cmde Kevin Fernandes was, creepily again, killed in a helicopter crash in the 1950s - in JK!) The appointment of then RAdm John C DeSilva to Chief of Naval Staff was a near miss. Several times since 1947, Goans held operational commands in the three services. Lt Gen Walter AG Pinto from Santa Cruz-Calapur was GOC-in-C, Central Command, Lucknow. Vice Adm John DeSilva commanded the Eastern Fleet of the Indian Navy. Air Marshal Terence J de Sa from Sangolda was Air Officer Commanding-in-Chief, Southern Air Command, like AVM Erlic Pinto, AOC-in-C, Western Air Command before. Lt Gen Francis T Dias from Velcao was Chief of Staff, Southern Command. Or get the import from another angle. In the Indo-Pak 1965 war, three vital High Altitude Passes were under Lt Gen Stanley L Menezes in Ladakh, Maj Gen Sidney Pinto at Jelep La and Maj Gen Eustace F D'Souza at Natu La. Lt Gen Eric A Vaz commanded an operational Brigade in Punjab. During the 1971 war, Goans commanded three operational Infantry Divisions: Lt Gen Walter AG Pinto in Punjab, Maj Gen Benjamin F Gonsalves in Bangladesh and Maj Gen Eustace D'Souza in the Kashmir valley.
