I don't see it happening anymore. That being said, it didn't happen
every time in Feisty either. It only seemed to happen when the system
was especially slow shutting down.

I just found the setting in synaptic that only installs packages by
preference on gutsy instead of the highest version, Once I changed the
setting the upgrades installed ok.

could just as well be in HAL or gnome?
