Re: [Videolib] Is Huis Clos (1954) in public domain?

2014-12-16 Thread Jessica Rosner
I should point out that the GATT treaty did not effect films made before
1923 so as in the US any film made through 1922 is PD but the specific
version ( copy) of the film my be under copyright thus CABINET OF DR.
CALIGARI is PD but not the Kino blu ray.

I am not a copyright lawyer, but I am French-educated.

For a French production you are dealing with the question of the rights of
the author (for motion pictures in France, typically at least whoever wrote
the screenplay). Laroche died in 1962-- and Sartre in 1980, so I would say
it is incredibly safe to say, not PD, but unfortunately very much OP in the
US.

I believe you can still get new legal Region 2 DVDs from France (it's
listed on fnac.fr).

Re: [Videolib] Is Huis Clos (1954) in public domain?

2014-12-16 Thread Jessica Rosner
This is a pirate site trying to justify itself. There is no such thing as
"collector to collector" sales, it is a bootleg
As for this film specifically because of the GATT treaty basically nothing
made in France or other European countries as well as many others is PD
unless in the very, very rare instance it fell PD in its own country and as
France has the most stringent copyright laws in the world in my view ( A
TRIP TO THE MOON only became PD there about 7 years ago) it is virtually
impossible for this film to be PD.

Any site selling European films and claiming they are PD is lying as they
are lying about "collector to collector" sales.
Not like rights holders are going to be checking out pirate sites and
providing them with "proof of ownership" when they know full well they are
illegal.

There is a reason you can only find some "rare" films on sites like this
and it because they are not legal
