You can't use ULS for earth stations. Earth stations are covered by
the international bureau as opposed to the wireless bureau.

It seems like most other ULS entires, they have a contact address
 and a
 person's name.

I did a Geosearch of Orange County, FL (the Sprint Communications
 Orlando,
FL county) using Frequencies 3500 to 5000mhz (All Service Types),
 and found
nothing but a cancelled point to point license for ATT.

A quick search of the FCC site for Sprint's filing #
 (SESRWL2000101902129)
finds nothing but the mention in the FCC 3650 FSS list. If I were
 to call
the FCC with that number would they be able to provide me contact
information for that company that pertains to the FSS department?

I wonder if creating a website that documented all the FSS contact
 info,
combined with map distance, automatic EIRP / bearing calculations
 (i.e. the
stuff the FCC talks about in their 3650 document), would be
 beneficial to
the other WISPs who want to serve the 125 million people who live
 INSIDE of
 these zones.

It seems silly, like a 5-10W transmitter pointing the opposite
 direction
would even make a difference - you would think the FCC would have
 integrated
distance AND antenna direction when it comes to base station
 registration...

Florida is flat. At 105km, I would need to have at least a 450 foot
 tower
or higher on both ends to even send a signal that far. 45 miles
 ended up
needing over 400ft on both ends. It's not like I want to broadcast
 3650
from the top of a 10,000 foot mountain peak.

Almost all of the zones near me (105km is the closest to the SW,
 146.7km
next closest to the South) and I have no desire to point coverage
 in that
direction - mainly north and northwest. But according to the FCC,
 I'd be

And even if I found a human being, it seems unlikely I'd talk to
 anyone

the power to make a real decision.

 Indeed.
Is this something best sent from a telecommunications attorney to
 their
 FCC
attorney of record? Is the consent more like a contract? Would
 they be
able to charge me for consent (like a spectrum lease)? Is this like
 asking

Excellent questions. Hopefully someone here can help.

such should have come with a disclaimer. Your claim of Please note that
I'm deliberately not listing vendors who only sell
sub-systems such as antennas, radio cards, etc. - only full-blown
radio systems suitable for outdoor use. An additional caveat is that
I won't knowingly list systems that are not FCC certified. is patently
untrue as you will notice below. I have added my comments on the vendors I
know personally. You have placed yourself as an industry leader for some
time now. I would have expected that you would not adopt a don't ask,

Patrick, as an Industry Leader, I would expect that you would not just
accept anything as fact without researching the claim first. There are a
lot of people who accept what you say as fact.

While this information is not 100% accurate as the FCC has a lot of work

Sorry for the old reference, Ultramesh is no long with us. I only consult
at this time. I noticed some companies on your list that are not selling
certified gear, and as such should not be posted publicly as doing so by an
industry journalist. This would cause some people to purchase products that
they themselves would not have done so without your assertion.

However, I will follow up my statement with additional research.

Aruba Networks
I would have to say I am likely wrong here, and if they are on this list
please forward your FCC ID if you like. Their product page shows equipment
with the following Electromagnetic Compliance Although their url to
country certification list shows a 404 page.

# FCC Part 15 Class B
# FCC Part 15 Class C 15.207/15.247
# FCC Part 15 Class E 15.407
# ICES-003 Class A
# RSS 210 (CAN)
# VCCI Class A
# EN 61000-3, EN 61000-4-2, EN 61000-4-3, EN 61000-4-4

# EN 55022, EN55024 (89/336/EEC)
# ETS 300 328 (89/336/EEC), ETS 301 489 (89/336/EEC)
# ETS 301 893
# AS/NZS 3548 Class A
# RFS 29 (NZ)

Avantry

I find them at Wincomm, but not at the FCC site under Avantry or Witcom.
However, given the style and cost of their equipment, its unlikely that they
have spent the kind of RD money they appear to have spent without getting
certifed. Again if anyone from Avantry/Witcom or even Wincomm wants to
forward the ID# to this list please feel free.

Cambridge Broadband
They appear to sell outside the US and operate in 3.5, 10.5 and 26 Ghz FDD
equipment. As such they are unlikely FCC certified, but are likely
certified in many other countries. Looks pricey.

http://www.cambridgebroadband.com/contact.htm

CarrierComm

Appears to be an ASIC and OEM manufacturer for the cellular industry. That
one is out of my knowledge field, but my first thought would be that they
are compliant with the regulations for SDR.

CoCo Communications
They seem to have added a protocol to existing linux based equipment.
Question for the industry: If you change the firmware on existing access
points and rebrand them to your company, are you required to recertify the
equipment?

Deliberant
Nothing further on them.

EION Wireless
Appears to have bought the Wi-Lan product line. Their other equipment,
however doesn't show up under any FCC search. If anyone from EION wants to
chime in, please do.

GIL Technology
Seems to be the Taiwanese manufacturer for the old Wi-Lan product line.
http://www.gil.com.tw/eng/product/wireless/libra5800.htm

Qorvus
Nothing further on them. No FCC ID's for their WRAP board + linux offering
(based on LocustWorld) + CM9/Senao 2511MP based products.

RIAA Fights Back, Threatens Open Wi-Fi

If the judge rules that we're each legally responsible for all of the
traffic that comes through our ISP account, open, unprotected Wi-Fi hotspots
would become a serious legal liability, the hundreds of thousands
(millions?) of people who depend on their neighbors for Wi-Fi will be out of
luck, while altruistic (or ignorant) folks who leave their wireless networks
open could find themselves embroiled in an RIAA lawsuits even if they've
never shared a single song in their lives.

As most of you know, Congress in a misguided effort to save us energy money,
moved daylight savings time back 3 weeks from its original date.
Unfortunately for windoze, an update needs to be downloaded. You can get it
at http://windowsupdate.microsoft.com. The reason some people have the
download and some don't is that you have to turn on manually automatic
updates. If you don't have that turned on, any updates, including security
ones, need to be manually downloaded from the windows update site.

As much as I like seeing One Ring's name over and over I figured I
switch the subject line to match the tread.

Mike's comments below are accurate with regard to Redline's equipment.
However, it should be noted that Redline was not able to get their gear
certified at the full power output allowable for 3.65. It is for this
reason that Redline does not believe its gear will work in rural
markets. Remember, 3.65 was originally supposed to be for the rural
market, which means either Redline went wrong somewhere or the FCC did.
Additionally, Redline has not sought to get its indoor CPE certified for

3.65 because of the power issue. That means urban operators are not able

to offer self-install options that would greater speed up the rollout
 process.

I believe WISPA should be working with the 3.65 radio vendors and the
FCC to get things fixed such that there will be a greater opportunity
for operators to provide services using 3.65.

Re: [WISPA] Update from the FCC on 3.65Ghz and CBP

2008-07-03 Thread David Peterson
There are cheaper options than 10k per sector but you are correct that's
about the going rate between 10 and 15k per sector. However, this equipment
is not anywhere near the same as the tinker toys as Scriv puts it. This
equipment will last you much longer than the commodity equipment. It's
easily twice as spectrally efficient and allows for a much easier
deployment. A number of WISPS are moving to this platform as they find that
the higher end equipment is worth more on a buyout.

Lets put it this way. If you have a network to sell, how much more do you
think you will get if you have Cisco instead of Mikrotik? Nothing against
them, but the quality of your infrastructure is heavily weighed during a
buyout. If you don't agree, check the many spam's on this and other lists
from the guys buying networks. Some won't even look at you if you don't
have Canopy or better equipment.

Subject: Re: [WISPA] Update from the FCC on 3.65Ghz and CBP

I hope all of you will read this post. I have spent a long time
writing it and I think it is very important for us to all think about
 the issues involved.

How about if we tie the 3.65 GHz band to one technology with our
wallets instead of making Uncle Sam do it with regulation? We will see
which platforms dominate over the next 5 years in wireless broadband.
We are going to see some movement away from 802.11 based systems as a
platform for delivery of outdoor broadband in all bands in my opinion.
I think we will see a move toward licensed WiMax and LTE systems used
predominantly for wireless broadband delivery as the next few years
progress. I have little doubt that other platforms will be put to use
but innovation will not occur from multiple platform distractions away
from the goal of building efficient, cost effective and unified
 systems for outdoor wireless broadband.

Do you think mixing several unrelated technologies into he same band
is a good idea? I believe that we need to be using ONE platform in
3.65 and we need to all support it. Fragmentation of support, vendors,
operators, etc. does not help our collective efforts. We need to
decide on a platform and all of us need to use it if we are ever going
to make headway as a group. The rest of the world is building WiMax in
3.4 thru 3.8 GHz. I just cannot see why we have to reinvent the wheel
here. I assure you that if we all built on this platform that we could
get the regulations changed to allow for WiMax use across the entire
50 MHz of this band. With GPS sync and 6 non-overlapping channels we
could certainly avoid interference and deliver quality wireless
 broadband in 3.65 GHz.

How does our industry standardizing on a platform like WiMax in 3.65
GHz stifle innovation? I think it does the opposite. I think it
provides focus and clarity and economies of scale for a platform
designed to provide outdoor wireless broadband. It is our best shot at
building interconnected networks with scale and an exit strategy for
operators, many having been running wireless broadband networks for
over a decade. We are not getting any younger and someday we need to
have something that someone will want to buy.

I have given much thought to this. I am sure some will doubt what I am
saying but I feel very strongly that we need to be setting a standard
and supporting it as a group. If we cannot mass our buying power
collectively toward a common platform VERY soon then we will not have
to worry about it much longer because deeper pockets will do it for
 us.

By most all accounts Telecoms with DSL and CableCos with DOCSIS have
flourished by choosing industry standards for their broadband
platforms and using it. They all support these same standards. I
remember the early days of cable modems when there were 50 proprietary

[WISPA] CALEA Question

2007-05-02 Thread David Peterson
As I am finding myself back into sales, I have a question concerning CALEA. I
just read this blurb:

The “facilities-based” terminology was meant to include providers offering
connectivity infrastructure between end users and the Internet. However,
establishments that acquire broadband Internet access service from a
facilities-based provider to enable their customers to access the Internet from
their respective establishments are excluded. The FCC explicitly exempted
retail providers such as those offering hot spot WiFi (News - Alert) service
where the actual Internet connectivity is obtained from another provider

From this site: http://www.rad-info.net/fcc/calea1.htm

This would indicate to me that if you are a retail provider, i.e. you buy your
broadband from someone else and resell it to your customers, that you are
exempt. This would suggest that the onus is on your provider to monitor your
T-1 or other connection to them in the event of a need for a tap.

Any clarity on this would be great.

Trying to help someone out of a contract is illegal (unless you are
their legal counsel). Ask your attorney if you want confirmation of
this. The better approach is to sell your service in addition to the
existing service. Tell him this provides a backup service in case one or
the other is down and it provides enough cost savings to pay for your
service. If he wants to get out of his contract then let him do it himself.

Even if he can't get out of the Cingular contract, I would think
paying you your normal rates would cost less than $1200 to Cingular.
Suggest that your unlimited service is still less expensive than
 overages.

 Mike Hammett wrote:

I have a potential customer that wanted to try out my service.
He's got money, so I wasn't afraid he was looking to get something
for nothing. He has Cingular now and can only get 125 - 175 kbit
out of it. I clearly can provide a faster less latent service for a
lower monthly cost (costs him $70/month).

Apparently he wasn't on the unlimited rate plan and got hit with a
$1200 bill. He doesn't think he can get out of his Cingular. *argh*

That said, can anyone think of a way to hookup a standalone fax
machine with the Cingular card? I can't contemplate anything at all.

Need a very quick solution to a very aggrivating problem. BellSouth and Us
have been arguing for months over excess charges on our bill from when we

shut off our phone lines into our office. *There way of making us
pay for stuff we do not owe them for *

I am needing an almost overnite VoIP / Virtual Office type setup from
someone who has reasonable pricing and a damn good service. If you are going
to call and expect us to pay more then $100.00/mo for a 1-800 # type setup

If anyone has any solutions they would like us to take a look at , we will
be making a decision today by noon.

Paul - I recall a wireless operator wanted his field

field repair jobs on CPE, check network status, etc.
They wanted to do this over Verizon but also WiFi. And
they wanted session persistence so the field

every-time he dropped the signal...or They wanted to
keep the trouble ticket 'hot' and I think you can do
this with the volatile memory on the PDA which then
refreshes when you gain the signal.

RE: [WISPA] Legal Charges used in Malicious Interference Situations

2007-09-12 Thread David Peterson
I would have to disagree with most of this thread. You have two things going
against you in this.

1. A free market economy.
2. License Free spectrum.

You can no more sue for someone putting up wireless in your area than you can
if you owned a restaurant and McDonalds moved in next door. This is a critical
component of American society, so I doubt that any judge would even allow the
suit to ever get in front of a jury. If you can prove they are doing something
illegal, like shooting your antennas with a .22 you might have a chance.

License free spectrum means that you are going to get interference. Period.
If interference were actionable, then Canopy would be out of business. Let's
face it guys, Canopy interferes with most of all other equipment in its
spectrum. By now, someone would have sued Canopy both on their equipment and
on their marketing. (Who has seen the Wireless Thug pic at the shows. I know
I have.)

Your best bet is to prove that they are using unauthorized gear such as amps,
etc. and cajole the FCC into investigating.

Jack,

I don't think it would have to be anything illegal about the
interference. If someone moves into an area established by you - where you
have an ongoing business and (for instance) someone hangs some Canopy and
creates the inability to recover from the noise - - that is a law suit in
the making. I am sure you would have to do all you could do and present the
evidence of such, but the one who knocked you oout of business would be

My partner (20% owner) is a Corporate attorney and we have had this

what grounds he bases this line of thought.

 Onlist for my reply.
It's also a good onlist discusion.

I have always believed that there is some way to combat someone who
intentionally causes interference with an existing network to cause
 harm
to the business or operation and or for financial gain.

I'm not a lawyer, so I can't even give any advice that would be worthy
 of taking to court.

But, to me, it's just unbelievable that criminal case can't be brought
against the offending party. The same way the Ricco statutes were first
used against the mob and in other racketeering cases.

Statutory remedies for intentional acts. Many statutes provide remedies
for intentional harms. Civil rights statutes provide remedies for
intentional discrimination. Consumer fraud statutes provide remedies
 for
unlawful trade practices. The federal RICCO statute provides remedies
for victims of conspiratorial intentional conduct.

RE: [WISPA] Legal Charges used in Malicious Interference Situations

2007-09-13 Thread David Peterson
Hey Mac,

You can disagree with disrespect, this is opinion. :

However, let me break this down for you and others on this thread.

If 1 guy moves in the area, follows the rules and raises the noise floor,
should you be able to engage in anti-competitive practices by asking that he be
shut down? What if 15 move into your area and all compete?

The only way that I could see having a leg to stand on is if he is deliberately
attempting to interfere with your business instead of pursuing his normal
course of business.

As one guy pointed out, I am not a lawyer.

I disagree totally :) with all respect!

I also think that Canopy ought to be illegal in the USA. They built
something that is totally spectrally unfriendly - on purpose! The commercial
that they use to air was the last man standing. I didn't say that Canopy
didn't build some pretty good gear - I said I hate their guts and wouldn't
hang it if it were given to me for free due to the noise they create. I
would love to see their gear recalled and outlawed. I can produce that
commercial/ad in court and if you think you would stand a chance in civil
court against an ad like that - - you are in for a surprise - - -unlicensed
spectrum or not!

We (all the WISP's) have a pact in N. Louisiana - - no one buys Canopy!

I would have to disagree with most of this thread. You have two things
 going against you in this.

 1. A free market economy.
 2. License Free spectrum.

You can no more sue for someone putting up wireless in your area than
you can if you owned a restaurant and McDonalds moved in next door.
This is a critical component of American society, so I doubt that any
judge would even allow the suit to ever get in front of a jury. If you
can prove they are doing something illegal, like shooting your antennas
with a .22 you might have a chance.

License free spectrum means that you are going to get interference.
Period. If interference were actionable, then Canopy would be out of
business. Let's face it guys, Canopy interferes with most of all other
equipment in its spectrum. By now, someone would have sued Canopy both
on their equipment and on their marketing. (Who has seen the Wireless
Thug pic at the shows. I know I have.)

Your best bet is to prove that they are using unauthorized gear such as
amps, etc. and cajole the FCC into investigating.

 Jack,

I don't think it would have to be anything illegal about the
interference. If someone moves into an area established by you - where
 you
have an ongoing business and (for instance) someone hangs some Canopy
 and
creates the inability to recover from the noise - - that is a law suit
 in
the making. I am sure you would have to do all you could do and present
 the
evidence of such, but the one who knocked you oout of business would be
 responsible for your lost income.

My partner (20% owner) is a Corporate attorney and we have had this
discussion on several occasions. I will ask him what his take on this
 is and
what grounds he bases this line of thought.

  Onlist for my reply.
It's also a good onlist discusion.

I have always believed that there is some way to combat someone who
intentionally causes interference with an existing network to cause
  harm
to the business or operation and or for financial gain.

I'm not a lawyer, so I can't even give any advice that would be
 worthy
  of taking to court.

But, to me, it's just unbelievable that criminal case can't be
 brought
against the offending party. The same way the Ricco statutes were
 first
used against the mob and in other racketeering cases.

 remedies

intentional discrimination. Consumer fraud statutes provide remedies

  unlawful trade practices. The federal
