MTS licence revoked by Kosovan authorities

MTS Kosovo, the Kosovan division of Serbian state-owned telco Telekom Srbija, 
has reportedly had its licence revoked by Kosovan authorities. There are a 
differing accounts regarding the justification for the cancellation however. 
Telekom Srbija claims that a decision by the Business Registration Agency 
(Agjencise per Regjistrimin e Bizneseve, ARBK) ‘seemingly’ rescinds MTS’s 
licence with immediate effect, on the basis that a member of the company’s 
management has a passport issued by the Republic of Serbia. The operator notes 
that all of its senior officials use documents issued by temporary institutions 
in accordance with the Brussels Agreement, the EU-brokered deal between Kosovo 
and Serbia under which MTS was established. Local press have noted, however, 
that the company was included in a list published by the Ministry of Industry 
Entrepreneurship and Trade (Ministarstvo Industrije, Preduzetnistva i Trgovine, 
MIPT) of firms facing sanctions for filing registration documents with 
‘unconstitutional’ content. Specifically, the companies listed the country 
sections of addresses located within the territory of Kosovo as Serbia.

Telekom Srbija intends to continue operating and will challenge the decision, 
which it describes as ‘absurd’ and ‘factually and legally unfounded’. 
Statements from the firm and from senior officials have not addressed the 
allegations regarding the company’s registration documents.

 , MTS – which is commonly referred to as ‘MTS doo’ to distinguish it from its 
Serbian parent, which uses the same brand name – is also under investigation 
for failing to disclose to the authorities its acquisition of three companies 
between 2019 and 2021.
